The NFL apparel class action lawsuit was filed in October 2012 by plaintiff Patrick Dang. He alleged the NFL and Reebok conspired to fix the prices of NFL-branded apparel in violation of California’s antitrust laws.
Dang alleged the NFL and Reebok entered into a licensing agreement in 2000 that gave Reebok sole permission to sell NFL team apparel with team logos. According to the NFL class action lawsuit, this agreement resulted in a price increase.
Michael Villa took over as Class representative in the NFL class action lawsuit after Dang stepped down due to health issues.
After extensive negotiations, Reebok and the NFL agreed to pay $4.75 million to settle the NFL apparel class action lawsuit. The defendants deny the allegations but agreed to the NFL apparel settlement to avoid the burden and expense of ongoing litigation.
Class Members of the NFL apparel settlement included any consumer who purchased jerseys, hats or shoes bearing an NFL logo (or the logo of an NFL team) from a California retail location between Oct. 25, 2008 and April 1, 2012.
Under the terms of the NFL apparel settlement, Class Members were entitled to payment based on the type of product they purchased. Class Members who submitted proof of purchase could receive up to the purchase price of the merchandise, while Class Members without proof of purchase could claim a maximum of $45 for a jersey, $45 for shoes and $15 for a hat. However, the amount of money distributed to each claimant depends on the total number of Class Members who filed claims.
The deadline to file a claim for the California NFL apparel class action settlement passed on Sept. 3, 2016.
