Navy-Federal-CU

Navy Federal Credit Union has agreed to settle a class action lawsuit alleging it used an automatic telephone dialing system to call cell phones without the prior express consent of the recipient, in violation of the Telephone Consumer Protection Act (TCPA).

If you received one or more phone calls from Navy Federal Credit Union and you did not provide prior express consent to receive these calls, you may be entitled to a payment of up to $1,500 from the TCPA class action settlement.

Plaintiff Ronald Munday alleges that Navy Federal Credit Union (NFCU) called his cell phone in search of someone else, and continued to call him even though he informed NFCU that it was calling the wrong cell phone number. He says that, because he never gave his consent to be called by NFCU, the credit union violated the TCPA.

The Telephone Consumer Protection Act is a federal law that regulates the use of automatic telephone dialing systems to make calls to a cellular telephone, absent an emergency or the prior express consent of the call recipient.

The Federal Communication Commission has recognized that automated telephone calls are a greater nuisance and invasion of privacy than calls made by a live solicitor. The FCC also recognizes that wireless customers may be charged for incoming calls, causing consumers to potentially suffer a financial injury on top of the nuisance.

NFCU has denied any wrongdoing but agreed to pay $2.75 million to settle the TCPA class action lawsuit and avoid the expense and uncertainty of ongoing litigation.

If you would like exclude yourself from or object to the Navy Federal Credit Union settlement, you must do so no later than Jan. 18, 2017.

Who’s Eligible

Class Members of the TCPA settlement include: “All persons whom Navy Federal called on their cellular telephone number using an automatic telephone dialing system between October 9, 2011 through September 15, 2016 where the result of that call was that Navy Federal coded the number as a ‘wrong number’ in its records based on information provided by the call recipient.”

Potential Award

Up to $1,500, depending on the total number of Class Members who file timely and valid claims.
