Nissan class action lawsuit

A settlement has been reached in a class action lawsuit alleging certain Nissan Altima vehicles contain a defect that causes dashboards to melt, crack and become sticky when exposed to prolonged heat and humidity.

If you are a Florida resident and you purchased or leased a new or used 2008 or 2009 Nissan Altima in the State of Florida on or before Apr. 1, 2017, you may be entitled to benefits from the dashboard defect class action settlement.

The Nissan Altima class action lawsuit was initially filed in November 2014 by plaintiff Tracy Sanborn. Plaintiff Louis Lucrezia joined the litigation in January 2015.

The plaintiffs allege that the material used to make dashboards in 2008 and 2009 Nissan Altima vehicles was unable to withstand the heat and humidity that is common in Florida.

According to the Nissan Altima class action lawsuit, this alleged defect caused the dashboards to crack, melt and become sticky when exposed to prolonged heat and humidity. In many cases, the dashboard would develop a glossy and reflective sheen that created a glare on the windshield, the plaintiffs claim.

Nissan denies any wrongdoing but has agreed to settle the dashboard defect class action lawsuit to avoid the burden and expense of trial. The Nissan class action settlement was preliminarily approved on Aug. 10, 2016.

Who’s Eligible

Class Members of the Nissan settlement include: “All consumers who are residents of, and purchased or leased a new or used 2008 or 2009 Nissan Altima in the State of Florida on or before April 1, 2017.”

Potential Award

Nissan has agreed to reimburse Class Members for the cost (minus $250) of replacing the dashboard. According to the settlement documents, the cost to replace or repair the allegedly defective dashboard costs between $1,500 to $2,000.

If you are unable to afford the cost of replacement or repair, you may go to a Nissan dealer and obtain a written quote for the price of the dashboard replacement and submit that quote with your Claim Form.

The Settlement Administrator will send payment to the dealership (or provide you with a check made out to the dealership) for the replacement of the dashboard. You will still be required to pay $250 to have the dashboard replaced.

Proof of Purchase

You should provide proof of payment for the dashboard repair/replacement when you submit your Claim Form. If you cannot provide proof of payment, you should provide the name of the Nissan dealership that performed the replacement and the date of repair. Nissan will attempt to verify the repair and will only provide reimbursement if it is able to do so.

Claim Form Deadline

As soon after replacement of the dashboard as possible, preferably by June 7, 2017.

NOTE: The dashboard must be replaced, or its deteriorated condition documented by Nissan in preparation for replacement no later than April 29, 2017.

    I have a 2010 Altima Nissan and live in Florida…..I just noticed my whole dashboard has cracked besides the issue of it being very sticky since the first day I bought the vehicle. Spoke with my salesperson @ HGreg Nissan Delray and informed me to contact Consumer Affairs. Spoke with Consumer Affairs and told me they would not reimburse me, not even a good will. I have researched the lawsuit and have learned that the 2008 and 2009 had faulty dashboards that could not stand the heat in Florida! Can they prove they changed the material of the dashboard installed in 2010? I am entitled with at least a “Good Will” to get my dashboard fixed!

    How you want us to pay $250 to the dealership to do I dashboard when its a dfit please answer that question we just don’t have no $250 to pay out when it’s not our fault that the dash board is messed up

    I didn’t receive a notice about this law suit I have a altima 2008 and the dashboard is sticky and melting is there any way to get any help for it now?

    I have a 2009 Nissan Maxima with the same problem and it’s a real safety issue due to the glare on the windshield hopefully someone does not get in an accident due to this Nissan needs to step it up and fix all the problems

    My 2008 Nissan dash has several cracks. It’s also melted from living in Florida since 2010.
    It feels and looks like black electrical tape. I have dog hair stuck to my dash. I have tried almost everything to try to get what’s already stuck to it off. To no avail.
    I might as well shave my dashboard?
    Any suggestions?

    My 2008 Nissan Maxima dashboard has a split in it. It was there when I purchased the car but it was very little but over time it has gotten longer. I live in Mobile, Ala, I don’t think I can fill from Mobile because I’m not a Florida resident, can I?

    I had the same problem. I took it to my Nissan dealership who said Nissan would cover new dash but I had to pay for labor. My windshield had a chip in it so that was replaced at the same time for a reduced labor rate in installing the new dash. Good as new!

    I also have a 2009 Nissan Maxima SV with the dash cracking and surface decomposing . I am aware of the settlement with the 2008 & 2009 Altima’s. I put in complaint back in 2016 with North America Nissan , went to Royal Palm Nissan , they said they have never seen this before .Gave us quote for replacement, including the plastic, behind the 2 front seats , that is also cracking . Filed 2nd Claim last Saturday, May 20th, 2017. Nissan called me back stating will not help to replace anything or even meet me half way . Would not even consider a good faith resolution. Where do I stand ?

    I have a 2009 Maxima and my dash has the same sticky problem. Any news on a claim for Maximas???
