MediFit Corporate Services Inc., also referred to as Exos, has agreed to resolve a California wage and hour settlement by paying $1.3 million to settle numerous labor law violations.
This class action California wage and hour lawsuit was brought forward by a group of personal trainers and exercise instructors who alleged the company owed them unpaid wages and overtime, and denied them rest periods and meal breaks.
A California federal court recently gave its final approval to the California wage and hour settlement after reviewing the evidence produced in the class action lawsuit.
According to the claims made in the class action California wage and hour lawsuit, the company would regularly deny meal breaks and rest periods to personal trainers and instructors and would produce inaccurate wage statements.
In addition, workers would regularly work over eight hours a day but were not paid overtime.
By doing this, MediFit had broken numerous state and federal labor laws by failing to pay overtime wages and compensating the fitness employees for missed rest periods, meal breaks, and out of pocket expenses.
Overview of California Wage and Hour Settlement
Lead plaintiff Francisco Flores stated the company had encouraged, and almost required, trainers and instructors to “work off the clock” because they were being paid by “session rate” but were only compensated for the classes they taught.
In addition, these employees were not reimbursed for equipment or the music they bought for their classes along with any continuing out of pocket fees.
Furthermore, these trainers were not paid for the time spent researching routines and setting up choreographic workouts.
Based on the documents that were produced during mediation and informal discovery, class members were confident in the decision to pursue class certification.
According to the California wage and hour settlement approval motion filed in October 2016, the parties had reached agreement “only after extensive, hard-fought adversarial negotiations” and several mediation meetings.
According to the California wage and hour settlement approval, it notes, “not a single Class Member as opted out and not a single objection was made to the settlement.”
Along with the $1.3 million California wage and hour settlement, the court had also awarded the plaintiff party $325,000 in legal fees.
According to the MediFit website, the company employs over 2,000 fitness professions who work with a variety of clientele.
These clients include corporate, academic, and military clients who rely on the personal fitness instructors of MediFit.
