Olympic-rescue-itA class action lawsuit filed against Olympic-brand paint manufacturer PPG Industries Inc. alleges that its “Rescue It!” concrete and deck sealant is defective.

The complaint asserts that the Rescue It! products “invariably crack and peel, failing in their represented purpose and qualities and causing significant damage.”

According to the class action, “despite the availability of reasonable alternatives and its knowledge that the Rescue It! Products are defective, PPG continues to manufacture, market, and sell them.”

The Olympic defective sealant class action lawsuit alleges that PPG is one of the largest paint manufacturers in the U.S., and it advertises its Rescue It! brand of sealants, resurfacers, and primers for their “durability, longevity, and low maintenance qualities.”

According to PPG, Rescue It! is the “ultimate remedy for severely weathered or damaged wood and concrete,” that “fills cracks up” and “provides a barefoot friendly, extremely durable surface that resists fading and creates a mildew resistant coating while giving new life.”

The complaint also cites the warranty on cans of Olympic Rescue It! which state that “Olympic guarantees satisfaction” with its products. That advertising and warranty are false, according to the class action.

The lawsuit cites numerous online complaints on various websites written by customers who are angry that their Olympic Rescue It! sealant peeled and flaked after less than a year, typically.

In addition, the class action argues that PPG knew its Rescue It! products were defective from these complaints, but continues to advertise them as high-quality.

All seven plaintiffs bringing the class action lawsuit against PPG similarly claim that they purchased Rescue It! which failed prematurely.

Plaintiff Greg Hoover says he purchased and applied Rescue It! in June of 2015 to his wood deck in Georgia. Hoover claims that despite applying two coats of resurfacer and sealant as directed, it started peeling in early 2016 and damaged his deck.

Likewise, Renee Gravlee of Alabama states that she purchased and hired contractors who applied the Olympic resurfacer on two different decks in 2013. Gravlee asserts that the Olympic product failed within the first month of use, and now her decks will need to be replaced.

Plaintiffs John Davis of Arkansas, Jan Pankow of Wisconsin, David and Casey Reif of South Carolina, and Elizabeth Mortensen of Pennsylvania allege that they had the same experience with Rescue It! sealant.

All seven plaintiffs claim that they purchased Rescue It! products because they thought it would last for years, and would not have purchased the products had they known that the resurfacer was defective.

Consequently, the plaintiffs seek to represent a Class of “All individuals and entities that reside in Georgia, Alabama, Arkansas, South Carolina, and Wisconsin who purchased Rescue It! Products.”

The complaint also sets out proposed subclasses for purchasers of each of those states, and an additional subclass for residents of Pennsylvania.

The class action alleges violations of state consumer protection laws and federal warranty laws. The plaintiffs request treble damages, as well as an injunction stopping PPG from selling its defective Rescue It! products.

The plaintiffs are represented by James F. McDonough III, Taylor C. Bartlett, and W. Lewis Garrison, Jr. of Heninger Garrison Davis, LLC.

    I have a deck I did with the product and it has not performed well at all. I need to re do it but don’t know what my next step should be. I started searching for information and found this website. I bought my product at lowes and still have 2 partial cans left that I had saved. Is it to late to get in on the lawsuit? It looks like to do this correctly I need to replace the whole deck surface and the handrails.

    I used Rescue in late April 2015, scrupulously following the directions on the bucket. It began peeling the following year. I used left over paint to fill in the bare spots after the wood had a chance to dry. New places peeled. Patched those. More peeled this year. Am tearing out the deck and replacing since the places that haven’t peeled don’t come off completely with any method.

    I used this product spring of 2016 and within 4 or 5 months it started peeling off. In the spring of 2017 I hired someone to sand and prepare the wood on the places that peeled. I took what I had left of the product to Lowes and had them shake it and then had the helper repaint those areas. Those areas looked good for about a month and other places continued to peel off and now my deck looks terrible. I’m embarrassed to let anyone see it. Now I have to hire someone to try to remove the stuff. This has turned out to be a very expensive undertaking when it should not have. I would like to join the class action law suit so I can possibly get some of my money back. It was a total ripoff. How can I join the class action lawsuit before the August 2018 deadline?     I have approx 800 sq ft of decking. I used rescue it and it started flaking and peeling within six months. I contacted Lowes where I bought it and they gave me a contact number for rescue it. Olympic repaid me for the price I paid for the rescue it but has done nothing else for the mess my deck is in. I no longer have my receipts nor my contact person with olympic. However, I can probably get copies of my receipts from Lowes. This year we have even tried to strip it, but nothing will take it off. It only come off in strips as it continues to flake and bubble. Is there any way I can join this class action suit?

    I bought Rescue It for my porch, deck and steps. I power washed all the wood. After it fully dried in a few days a I painted these surfaces. Within a few weeks chunks of paint flecked off in numerous places.

    I would like to join the class action suit.

    im having the same problem it just peels off and the wood looks awe full
    how to we enter this lawsuit? is there a number to complain about this product?

    This is the worst . Apply it and chipped within a year. Called the company and they gave us more to stain our deck but we can’t get the old stuff off. Our deck looks horrible !!

    My husband and I have bought at least 7 pails of this product if not more. When we first put it on our decks it looked great. Then about 4 to six months it started to fade and peel. Bought more to touch up big peel places and started to presure wash to redo places and more started to peel our decks are to big to scrape so we are stuck with what we have. This product is no good. It needs to be taken off the market.

    This stuff is worse than garbage. It traps moisture under itself on top of the wood because it doesn’t penetrate. Besides peeling it rots the wood underneath until it peels. Peeling is beneficial because then the wood can dry out.
    Stick with stains on decks. Got to get the old stuff out first. Chemicals and sanding and pressure washing gently. Open the wood up. And let it dry.

    I bought this product and painted my back yard around the pool. Six months later it was peeling. I talked to Lowes because that is where I bought then they gave me the customer service number which was difficult to get in touch with them. All paint was flying everywhere. I tried to scrape but could not do it due to health problems.
