Toyota interiorToyota Motor Corp., Toyota Motor Sales USA Inc. and Toyota Motor Engineering & Manufacturing North America haven’t lived up to their promise to provide comprehensive warranty coverage and repairs to owners of vehicles with defective dashboards, a class action lawsuit alleges.

Plaintiff Wendy George of South Carolina refers to a prior Toyota class action lawsuit, Graham v. Toyota Motor Corp., et al., which was filed in November 2014 and alleged certain Toyota vehicles had defective dashboards that would melt and create a glossy film when exposed to direct sunlight.

The alleged defect would reportedly make it difficult for drivers to see the road when sunlight reflected off the glossy film on the dashboard.

Graham’s Toyota class action lawsuit was reportedly dismissed after Toyota announced the implementation of a comprehensive warranty program in December 2014.

“The warranty program made promises [Toyota] could not keep,” George alleges in her melting dashboard class action lawsuit.

She says Toyota implemented the warranty program without having adequate replacement parts. She also claims that Toyota made the issue worse by only allowing consumers to obtain warranty service from authorized dealers who did not have sufficient inventory to make the repairs.

“Even today, approximately 1 year and 8 months since the commencement of the program, Defendants are utterly incapable of completing their dashboard warranty obligations in a timely or reasonable fashion,” the Toyota dashboard class action lawsuit states.

“Plaintiff, whose name has been on a wait list and will remain waiting on that list for many more years, will not receive the warranty repair prior to the expiration of the program,” the Toyota class action lawsuit continues. “Consequently, Plaintiff now seeks to remedy this breach of warranty for herself and a nationwide class of consumers.”

According to the Toyota dashboard class action lawsuit, George owns a 2004 Lexus RX 330.

She says her vehicle is affected by the Toyota dashboard defect and, like other vehicles affected by the alleged defect, the dashboard defect does not become apparent until after the comprehensive warranty period has expired.

George seeks to represent a Class of consumers who own one of the following vehicles affected by the alleged Toyota dashboard defect:

  • 2003-2005 Toyota 4Runner
  • 2005-2010 Toyota Avalon
  • 2007-2011 Toyota Camry and Toyota Camry Hybrid
  • 2004-2010 Toyota Sienna
  • 2004-2008 Toyota Solara
  • 2006-2008 Lexus ES 350
  • 2003-2008 Lexus GX 470
  • 2006-2008 Lexus IS 250/350
  • 2007 Lexus 460
  • 2004-2006 Lexus RX 330
  • 2007-2009 Lexus RX 350
  • 2005-2008 Lexus 400h

 

The Toyota class action lawsuit asserts claims for breach of express warranty, breach of the implied warranty of merchantability and violation of the Magnuson-Moss Warranty Act. George is seeking an award of injunctive relief, compensatory damages, attorneys’ fees, and other relief deemed appropriate by the court.

The plaintiff is represented by T. Christopher Tuck, A. Hoyt Rowell III, James L. Ward Jr., Robert S. Wood and Catherine H. McElveen of Richardson Patrick Westbrook & Brickman LLC.

The Toyota Dashboard Defect Class Action Lawsuit is George v. Toyota Motor Corp., et al., Case No. 2:16-cv-03006, in the U.S. District Court for the District of South Carolina.

    My Lexus 2012 ES 350 dashboard is melting and all I’m getting is excuses from Toyota corporate office and Westside Lexus dealership. I am afraid that my dashboard will catch on fire or the reflection on the dashboard could cause me to have an accident.
    Toyota never notified me by mail in regards to the warranty recall, I had to hear it from a service advisor at Westside Lexus dealership. No one is trying to fix the problem but keep passing me on to the next person who is telling me their is nothing they can do.
    What do I need to be apart of this Lawsuit?
    I will never purchase a Lexus again.

    I purchased a 2011 toyota camery from Gettel Toyota of Lakewood ranch fl that had the melting dashboard at time of purchase. when I inquired about it the sales person said it was damage done by a previous owner not telling me it was a manufacturing defect that was well known by the company outlined in 2 2014 lawsuits.

    When I brought it to Ryan Fischers attention this year general manager of gettel Toyota of Lakewood ranch fl oh boy the excuses and misrepresentations were flowing like a Katrina and a Louisiana Levee party.

    Everything from I wasn’t the general manager at the time to the warranty wasn’t in effect when the car was sold to my service manager just brought in the details and you’re not qualified you should have been in my service program we would have seen it when you brought your car in we didn’t see it because my guys aren’t trained by guys were wearing latex so they wouldn’t have felt it we don’t do warranty upsells but at the same time we reach out to people that have this condition due to an awareness campaign let me sell you a new car give me $1,600 talking in the third person if we fix it the dealership or Ryan Fisher’s going to come out of pocket and that’s not going to happen why not keep on driving it you’ve had it this long why didn’t you bring it to my attention earlier what took you so long just a litany of excuses deflections moving of blame to the customer. Is anyone else has ideas on how to pursue this legally which I am attempting to do I would appreciate feedback.

    I have a 2007 Toyota Camry LE, I bought it brand new in 2006, and I am having the same problem with my dashboard. The rubber substance has melted and years ago I bought a velcro cloth dash-cover to cover it. I love my Camry because I am a Camgirl, but planning on selling it soon. I hope this lawsuit takes place before I sell my vehicle to someone else. Toyota has disappointed me with this make and model!

    My 2097 Lexus RX350 dashboard is kept in garage, it continues to crack more every day, soon there will be nothing but cracks everywhere, it is looking shabby and ugly.

    We have a 2009 Camry and it has a sticky, glaring dashboard. It totally is a hazard when the sun is glaring off the dash. Does someone have to get killed because of this before Toyota does something about it?

    I also have the issue with the sticky dashboard. I never received a letter notifying me of the supplemental warranty and now Toyota won’t pay to have the dashboard replaced. I contacted the corporate office and their Senior representative told me that there is nothing they can do. I told them it’s a safety issue since it causes a glare on the windshield which makes it hard to see. The representative actually told me “that’s on me” since he informed me that I could purchase a dashboard cover. So disappointed in Toyota.

    I just took my Camry to the Toyota dealership to inquire about my dash melting and putting a shine on my windshield. They informed me that the extended warranty has expired and that I will have to pay $1600 to replace my dash. If this is a class action, shouldn’t Toyota rectify all effected vehicles regardless of what they consider expired warranty? It is a Toyota issue. I was never notified of the issue or the extension of the warranty. But apparently it expired May 2018. I have contacted corporate and they also told me there was nothing they could do. I would have to pay out of pocket. I don’t understand how Toyota’s error is my responsibility to pay. Any advice?

    Took my 2009 Lexus IS 250 to Clearwater Lexus today they informed me I needed to contact Lexus directly in regards to my dashboard being sticky, gooey and peeling. Lexus informed me that they did extend it to 10 years but unfortunately my VIN number is not included so I will need to pay for the repair at my cost. I don’t understand how they can determine only certain VIN numbers to be an issue. It’s obvious my vehicle is having the same issue.
