A federal judge in California has allowed minor league baseball players who have filed a minimum wage class action lawsuit against Major League Baseball to seek recertification as a class, provided they narrow the proposed scope of the class and address outstanding issues.
The bid made by the players was granted in part by U.S. Magistrate Judge Joseph C. Spero and will allow the minor league players to file a renewed motion to obtain class certification.
About a month before approving the recertification, Judge Spero had decertified the proposed class of minor league players, ruling that the employment survey used to determine how many hours class members worked was flawed and said that the class members had differing experience.
Under Judge Spero’s newest ruling, the proposed class of minor league baseball players will have until September 12 to file a renewed motion in the minimum wage class action lawsuit by providing a narrower class definition.
The players will also be expected to correct the issues in the survey in the Fair Labor Standards Lawsuit, according to the court order.
The minimum wage class action lawsuit was originally filed in February 2014 and claims that baseball players in the minor leagues are not paid the federal minimum wage, nor are they paid overtime.
Some proposed class members earn as little as $1,100 per month during the baseball season even though they spend more than 50 hours working per week, the class action lawsuit claims.
The class in the minimum wage class action lawsuit was conditionally certified last October.
Before class decertification last month, more than 2200 minor league players had joined the minimum wage class action lawsuit out of a potential 14,800 players.
Judge Spero decertified the class of minor league players in July, which prompted the players to file a motion for reconsideration in early August.
The plaintiffs argued that the decision made by the court was based upon the pilot version of the survey regarding work hours, and the final version addresses the concerns brought forth by the court and demonstrates that the class should be certified.
Major League Baseball argued back that there was no reason to reconsider class certification, saying that the changes the plaintiffs have proposed failed to address the problems spelled out by Judge Spero.
