Navistar Class Action LawsuitNavistar International Corp. faces a defective diesel engines class action lawsuit over allegations it knowingly outfitted its 2008-2013 vehicles with defective emission systems in their engines, causing Navistar trucks to suddenly break down.

This Navistar class action lawsuit was filed last Wednesday in Illinois federal court by three trucking companies, Denis Gray Trucking, Carmichael Leasing and GTL Enterprises, who had purchased and used several Navistar model trucks equipped with the allegedly defective Maxxforce Advanced EGR diesel engines.

The three trucking companies allege that Navistar knowingly sold trucks that with the defective engines and thereafter failed to repair the defect before the warranties’ expiration dates, placing the burden of repair and maintenance on the truck owners.

According to the diesel engine class action lawsuit, “trucks equipped with the defective engines were not as represented by Navistar and were and are worth less than the price plaintiffs and class members paid, and what they would have been worth with an engine free from defects[.]”

Not only are the trucks a financial burden for Class Members to repair and replace the emission system and engine, but also result in a loss of profit for the Class, because the trucks have lost a great portion of their resell value thanks to the engine emission defect, the Navistar class action lawsuit says.

This Navistar defective diesel engines class action lawsuit addresses the engine defect found in Navistar’s heavy-duty and severe-duty trucks, which have been classified by the U.S. Department of Transportation as Class 7 and 8 trucks, making them the heaviest and most powerful trucks on the highways.

In their class action lawsuit, the three trucking companies allege that the defective Maxxforce diesel engine makes Navistar’s trucks unreasonably dangerous because the“Defect can and has led to sudden breakdowns, forcing Trucks, often heavily loaded with cargo, to attempt emergency maneuvers, such as pulling to the side of the road. The Defect also causes coolant and exhaust fumes to enter the passenger compartment of the Trucks, causing risks of driver poisoning from the fumes.”

The plaintiffs also allege that even when the trucks were brought in for repairs on the defective engines under the warranty period, Navistar would not repair the emission system properly and made regular practice of replacing the engines with emissions systems that were equally prone to fail.

The Navistar defective diesel engines class action lawsuit alleges that Navistar International was aware of the emission system defect as early as 2004, when the EGR system was used in 2004 Ford vehicles. “Ford faced an unprecedented number of complaints with Navistar’s 6.0-liter diesel engine, leading to Ford suing Navistar for supplying this defective engine,” the Navistar class action lawsuit says.

Based on these allegations, Denis Gray Trucking, Carmichael Leasing, and GTL Enterprises have filed the Navistar defective diesel engines class action lawsuit on behalf of themselves and other Class Members nationwide who purchased or leased 2008-2013 model Navistar vehicles outfitted with the defective engine emission system.

    10 months ago I purchased a 2019 with an A26 navistar I have had over 30k in out-of-pocket engine repairs. This has been a huge financial loss for me. Along with the inability to work to make money with my truck. The truck didnt even last 15,000 Miles. Devistating

    I have a 1996 Ford F350 with the 6.0 Liter Diesel, it cost me over $9000 dollars for repairs when a lifter broke due to push rods being to long causing the lifter bearing to get broken letting the needle bearings go all throughout my engine. I had approximately 130,000 miles on the truck when this happened. After the truck was returned from the shop the same thing happen again within a month of getting the truck back, the problem that time was a defective lifter holder that let the lift turn causing the needle bearing to get crushed letting the rollers once again got all throughout my engine. Can I get reimbursed for this costly error on Fords part?

    We purchased a 2007 International and have suffered great financial losses due to engine issues. Have had over $30k in repair bills plus loss of income from not working while the truck was in for repairs. How can we get involved to recover some of these losses

    I worked in the Chatham Ontario plant for 11 years as a quality pride monitor and I can tell you without a doubt not one of the trucks built from 1988 to 1999 were safetied by a certified truck mechanic prior to being placed on the road. Company officials would constantly sign of concerns we had about safety to avoid red tagging them and costing precious overtime dollars. They don’t care about quality, money is their only concern and always has been. Leaving Canada was hard for us to deal with but I’m sure they would have eventually had to answer to all the cancer patients they left behind! Your s scum bag company and I personally hope one day your competitors crush your asses to the ground!

    I just purchased a 2010 ProStar Eagle four months ago and I’ve had nothing but problems from the oil cooler assembly & breather assembly to the regen system, that cost me over $4000 in maintenance repairs..if you have any information on this class action lawsuit please contact me (586) 569-1737
