Waist training class action lawsuitWaist Gang Society LLC has been hit with a class action lawsuit alleging its Kim Kardashian-endorsed “waist training” products do not burn fat as promised.

Plaintiff Sara Hawes alleges Waist Gang Society sells a line of corsets that are marketed to women who want to have a smaller waist. According to the waist trainer class action lawsuit, these types of corsets have been around for a long time, but they have recently been hyped by endorsements from celebrities such as Kim Kardashian and rebranded as “waist trainers.”

“These ‘waist trainers’ do redistribute fat to other portions of the user’s body, thereby creating the perception of a fit and trim waist, however, Defendant claims that the Products actually burn fat and control the user’s weight,” the waist trainer class action lawsuit says. “This is completely false and misleading. The Products have absolutely no effect on fat loss of the user.”

Hawes, a Los Angeles resident, claims she purchased the Miracle Waist Shaper from Waist Gang Society’s website in November 2015. The website reportedly includes images of Khloe, Kim and Kourtney Kardashian wearing the waist training products.

According to the waist trainer class action lawsuit, corsets are effective at creating a slimmer waist. However, Hawes says Waist Gang Society takes its assertions about the products too far by claiming its reshaping products are made of a “unique latex material which attacks unwanted fat and impurities within your body.”

Although the latex material can cause the body to sweat, this sweating does not cause fat loss. The class action lawsuit points to studies that indicate corsets cause a redistribution of fat and organs to give wearers an hourglass shape, but that the corsets do not cause the wearer to permanently lose fat.

The waist trainer class action lawsuit also points to a recent article published in The Wall Street Journal that concludes the so-called waist training products “fail to promote fat loss and should simply be considered fashion accessories.”

Hawes claims she would have paid less for the waist training product – or not purchased it at all – if she had known that it did not promote fat loss as advertised.

Hawes seeks to represent a Class of all individuals in the United States and the state of California who purchased any of the following Waist Gang Society products: Sweat Fitness Belt, #1 Zip and Clip Boneless Shaper, Waistgang Comic WaistShaper, Fullbody Shaper, Funkadelic Cheetah Waistshaper, Latex Gym & Garment, Miracle Waist Shaper, No More Back Fat!, Python Waistshaper, Superhero Waistshaper and The Works!

The waist trainer class action lawsuit accuses Waist Gang Society of violating California’s Consumer Legal Remedies Act, False Advertising Law, Unfair Competition Act, and breach of express warranty.

Hawes is represented by Jonathan N. Shub of Kohn Swift & Graf PC, Nick Suciu III of Barbat, Mansour & Suciu PLLC, and Bassma Zebib of Law Office of Bassma Zebib.

    Honestly I looked good with them on, they hurt like I don’t know what at times, they roll, and I have left me with bruises and marks on my body for a couple of years now. No weight lost, a temperay fix for the evening at the end of the night it all will come out.

    They were marketed as a workout booster with ground breaking latex. The ads claimed that this would cause you to shed pounds and inches at a faster rate. All they do is make you sweat which can be achieved at a much cheaper rate. Of course there were women that just put them on and ate chips, but most of us used them as marketed.

    This suit is ridiculous. How dumb do you have to be to believe that wearing a waist trainer will burn fat. Seems to me that she is trying to make a quick buck.

    False advertisement to its fullest. Unfortunately, I also purchased one from waist gang society. They are over rated and certainly overly publicized. Does Not Do what it promises!!! Weight-loss and beauty product manufacturers have been getting away with a lot of hyped up images to broaden their sales and false advertisement to add value and added benefits to their products. They feel like the can get away with things so long as they can defend their claim using the concept that everybody is unique, results will vary, success based on individual etc…Enough is Enough, there ought to be a balance. Yes we are all unique, but if you claim that the product work on its own, with no life-style changes, then it should have some type of result.

    I will be following this one closely. I actually own 3 of these things. My first order was the wrong size which I ordered according to their size chart. They will not exchange items at all but offer a discount, so I bought 2 more at the price of 1. I fell for it because I had seen images all over facebook and they really do make you LOOK slim, but it’s just an illusion. Not to mention when they come apart you will have jagged metal stabbing you from all ends! Had they not promoted the weight loss benefits I certainly would not have bought any!
