Maidenform Shapewear Flexees iPant class action lawsuitChecks have reportedly been mailed to consumers who filed claims for a settlement stemming from allegations Wacoal iPants were falsely advertised as having slimming capabilities. Wacoal America Inc. claimed that its caffeine-infused undergarments could reduce the appearance of cellulite, but the company allegedly had no scientific evidence to back up these claims.

According to readers of Top Class Actions, checks worth an average of $59.48 have been mailed to Class Members who submitted a claim for the Wacoal iPants false advertising settlement. Congratulations to everyone who filed a valid claim and got PAID!

The Federal Trade Commission filed the false advertising lawsuit against Wacoal, and Wacoal eventually agreed to a $1.3 million settlement that would offer refunds to consumers who purchased the shapeware products. The FTC announced the settlement agreement on Sept. 29, 2014.

Consumers who purchased Wacoal iPant products after January 2011 were eligible to file claims for the false advertising settlement. The amount each claimant was eligible to receive depends on the type and number of products purchased.

The deadline to file a claim for the iPants settlement passed on May 19, 2015.

In addition to issuing refunds to consumers, the settlement also prohibits Wacoal from making future claims that an item of clothing is able to contribute to weight loss or a reduction of body size unless the claims “are not misleading and can be substantiated by competent and reliable scientific evidence.”

According to the FTC, the agency has mailed nearly 20,500 checks to consumers who bought the iPants products. If you receive a check from the iPants settlement, you must cash it by Feb. 17, 2016.
