A vegan Michael Kors customer has filed a class action lawsuit against the clothing company, claiming that it falsely advertises some handbags as being made of synthetic material when they actually contain animal products such as leather and fur.
Plaintiff Jennifer Goodwin alleges in the Michael Kors class action lawsuit that she was shopping online for a purse that would only contain synthetic materials and relied upon the product description for the Michael Kors Kempton tote which noted that it was “made of only nylon and PVC[.]” However, when she received the product, “she was shocked and disappointed to open the bag and find a card that read: ‘Fabric: Your handbag is made of uniquely designed fabric and trimmed with fine natural leather,'” the class action lawsuit says.
Goodwin claims she called a Michael Kors official to confirm what materials were used in the handbag and was told that the card noting the use of leather was accurate, and that the online description of the bag form the third-party retailer was inaccurate. This completely negated the point, since “as a vegan, [Goodwin] researched her choices and found a handbag that was advertised as not containing any animal products,” the Michael Kors class action lawsuit says. Goodwin claims that Michael Kors should still be on the hook for false advertising since it provides third-party retailers with the descriptions of its handbags for advertising purposes.
Further, regardless of whether or not other people share her beliefs, her class action lawsuit notes that since the employee told her that “all Michael Kors bags include leather,” all California residents who bought these products from the company directly have been exposed to false advertising in violation of state statutes, the complaint alleges.
Under the Consumer Legal Remedies Act, companies cannot mislead residents about the composition of a product, whether it is a fashion accessory like the Michael Kors Kempton tote or food.
