AlliedBarton class action settlementAlliedBarton Security Services companies have agreed to pay $11 million to settle multiple class action lawsuits alleging violations of California wage and hour laws.

Specifically, lead plaintiffs Gregory Dynabursky, Mikhail Babeshkov, and Jose Aguirre filed separate lawsuits alleging that AlliedBarton Security Services, one of the largest private security companies in the United States, failed to provide meal breaks; authorize rest breaks; provide accurate wage statements; and pay employees for all hours worked.

Plaintiff Babeshkov filed the first class action lawsuit in 2008. Dynabursky’s wage and hour lawsuit followed in December of 2012, and the Class was certified in January of 2014. Plaintiff Aguirre filed an action alleging similar violations in August of 2014. This settlement would resolve all three wage and hour class action lawsuits.

The AlliedBarton wage settlement represents a Class of “All non-exempt hourly employees who were employed by Defendants in California at any time from April 1, 2004 through January 9, 2015.” The companies believe that there are 43,893 persons in the Class.

If the AlliedBarton class action settlement is approved by the court, the $11 million fund will be divided among all those employees who do not opt-out of the Class. No claims will have to be filed by potential Class Members. Anyone who does not opt-out will be paid from the settlement on a pro-rata basis, according to the number of weeks worked for AlliedBarton Security Services.

The plaintiffs and AlliedBarton also agreed to increase or decrease the amount of the settlement fund, based on the number of people who join the Class. If it turns out that there are between 5 and 10 percent more former employees of AlliedBarton than originally thought, the settlement fund will increase by that percentage, up to 10 percent. Conversely, if between 5 and 10 percent of the potential Class Members opt out of the class, then the settlement amount will be reduced accordingly. Finally, if more than 10 percent of the eligible Class Members opt out of the class action settlement, the parties can void the deal.

If approved by the court, the AlliedBarton wage class action settlement administrator will send out notice to all identified members of the Class. The notice will have information about the class action settlement, and details on how class members may object or opt out of the settlement. Class Members who wish to be part of the settlement will not have to file any claims. After the time period for opting out is over, the parties will return to court to seek final approval of the settlement.

    Hi I’m looking for Gregory dynabursky my name is Jackson Manivanh and I got my check but it was void do to expired date do to the situation I did not received until later I ask for a reissue check but the firm said the settlement was closed and that’s. It do I need a lawyer
