A federal judge has preliminarily approved a $20 million class action lawsuit settlement offered to Bank of America customers who claimed the bank used deceptive marketing tactics to sign up and charge credit card customers for a useless credit-protection service. Some cardholders will be eligible for $50 and $100 awards under the class action settlement.
Credit card customers alleged in the Bank of America credit protection class action lawsuit that not only did the bank sign them up for its Credit Protection Plus service without their permission or through deceptive marketing, but that it also gave them nothing meaningful in return for the monthly fees they were charged. Bank of America charged customers for the service without authorization, enrolled them through deceptive marketing, and improperly denied benefits, the class action lawsuit alleged.
The Bank of America payment protection settlement is the latest in a string of settlements reached in consumer class action lawsuits accusing banks of deceptively marketing payment protection products and other add-ons to credit card customers. Chase credit card customers won a $20 million class action lawsuit settlement last year over the deceptive tactics, Discover card customers won a $10.5 million class action settlement earlier this year, and Capital One cardholders will receive $210 million as part of a class action settlement alleging the bank tricked them into buying unwanted “add-on” products such as payment protection and credit monitoring.
Bank of America admitted no wrongdoing in the proposed class action lawsuit settlement, but agreed to change some of its practices related to the Credit Protection Plus program, including waiving or eliminating restrictions previously imposed that did not allow enrollees to receive benefits. It also agreed to create a $20 million class action lawsuit settlement fund to pay credit card customers who enrolled in the credit protection service starting in 2006.
U.S. District Judge Thelton Henderson preliminarily approved the BofA credit card protection class action settlement on July 23, 2012. A Final Settlement Approval Hearing is scheduled for January 14, 2013.
Customers will have until February 26, 2013 to submit claim forms to receive money from the class action lawsuit settlement. Claim forms and an official settlement website have not been created yet. If there was a settlement I never received it, did submit a claim. I definitely never agreed to credit protection but was charged for it for many years.When I did notice the charge I called and told BOA to take it off and cancel my card. Yes, I am still paying on the card but when it is payed off I will never have another thing to do with BOA are their new found name Farm Bureau Bank.
$50.00 or $100.00 hardly seems fair. a lot of money was taken out of my account without my permission. when is bank of america going to make good on it. or is that another lawsuit?
I filled out the form to receive money ($100) from Bank of America class action lawsuit on the credit protection plan. I haven’t heard or received anything. I want my money…I paid into this plan for 3 to 4 years, then became unemployed, and they wouldn’t honor it. Continued to take money over a year, after I was unemployed. At least give me my $100. The settlement have occured….
I recall receiving my credit card statement with an extra
charge for credit protection. I filled out the information
for the lawsuit and I have still not heard anything.
My husband had been a card holder for many years. When he applied for the card he took out the credit protection plan in case something happened to him that the debt would be paid and I would not have to woory about it. After being daignosed with cancer in 2010 BOA didn’t want to honor the payment coverage; even turned him over to a credit company. Upon his death in July 2012 BOA canceled his plan and demanded that the money be paid in full. After thousends of dollars been paid in to cover this for years. Then nothing. We used up all of our savings and assets to fit the Cancer thinking g this was one thing we would not have to worry about. I just want BOA to MAN UP and honor what we all paid for. Where is all the MONEY we paid in…..
I still remember clear as day from years ago when the lady over the phone signed me up without my consent. She asked if I wanted to be mailed information about the protection program and then decide if I want to sign up. I said sure, a mailing can’t hurt.
On my next statement, I saw that she had charged me to sign up for the plan when I specifically told her NOT to! I was furious, and am glad this settlement went through!
I also recieved a Notice to File a Claim in the mail today from Gilardi & Co. LLC from Petaluma, CA regarding a B.O.A class action settlement.

Over the past 6 years or so my life has been a financial nightmare it is hard to recall but. Signing up for credit protection is something I would do.
this is my country usa. that suck’s that i should have to watch my back in my own country . wtf.
