A Georgia woman is seeking compensation for injuries allegedly suffered in a nighttime 18 wheeler accident.
Plaintiff Tricia C. files the 18 wheeler accident lawsuit demanding jury trial. The lawsuit was filed on June 26, 2018. Tricia is herself a resident and citizen of the state of Georgia.
According to the 18 wheeler accident lawsuit, Tricia had become involved in a motor vehicle collision that occurred on the night of July 14, 2017, roughly around 10:00 p.m. The collision occurred at Emerson, Bartwo County, Ga., off ramp Interstate 75 North at Exit 283 for Old Allatoona Road.
That night it was clear skies with dry roads, the lawsuit states. The driver of the truck was operating a 2018 Peterbilt tractor, driving northbound in the right lane of the the exit ramp. At the same time, however, Tricia was in her 2008 Honda Accord at a complete stop on the left shoulder of the exit ramp.
Suddenly and without warning, the lawsuit states, the 18 wheeler struck Tricia on the passenger side. Tricia claims that in an attempt at a hit and run, the driver tried to flee the scene and escape responsibility for his actions. However, she says witnesses of the incident followed the driver until he pulled over. Soon thereafter, an Emerson police office was called to the scene to investigate the collision and determined that the driver was the contributing cause to the accident, the complaint says.
The 18 wheeler accident lawsuit was filed on multiple counts including negligence, negligence per se, respondeat superior, direct action, and punitive damages.
