California consumers who shopped at a Ben Bridge jewelry store between 2010 and 2014 are receiving merchandise certificates in the mail valued at $55, thanks to a class action lawsuit settlement.
U.S. District Judge Gonzalo P. Curiel approved the Ben Bridge class action settlement on May 5, drawing to a close a nearly three-year legal battle over claims the jewelry retailer violated California’s Song-Beverly Credit Card Act by requesting and recording personal identification information (PII) from customers paying with a credit card. The law prohibits retailers from requesting or requiring PII such as zip codes and telephone numbers as a condition of a credit card transaction.
Ben Bridge denied any wrongdoing in the case (Steve Juhline v. Ben Bridge Jeweler) but agreed to provide $55 merchandise certificates to Class Members to resolve the litigation.
Class Members of the Ben Bridge settlement include anyone who used a credit card at a Ben Bridge store in California between Aug. 30, 2010 and Dec. 19, 2014; and Ben Bridge requested and recorded some of their personal information.
There was no claims process for the Ben Bridge class action settlement. All Class Members will automatically receive a $55 merchandise voucher unless they opted out.
Class Members will be notified of their award via U.S. Mail along with notice of the Ben Bridge settlement, or they will receive an email with notice of the settlement and a unique coupon code that will allow then to request a merchandise certificate by mail.
Certificates will be valid until March 8, 2016.
