Costco Wholesale Corp. is facing a class action lawsuit alleging the company falsely labels its brand name moist wipes as flushable even though they are known to cause toilet clogs and other plumbing issues.
The class action lawsuit was filed in New York federal court by plaintiff Desmond Armstrong, who claims he began buying the Costco brand name Kirkland Signature flushable wipes in March or April.
He alleges that after a few months of using the wipes and flushing them he experienced clogging and plumbing problems in his home in Oregon.
The Costco wipes are manufactured for the company by Nice-Pak Products Inc., which is also a defendant in the lawsuit. Armstrong supports his allegations by pointing out that the problem he experienced is clearly widespread based on a recent settlement reached between the Federal Trade Commission and Nice-Pak.
According to the class action lawsuit: “Through the… use of flushable wipes, consumers across the country experienced plumbing issues, including clogged toilets, clogged pipes, flooding of home basements and other plumbing problems. Plaintiff and members of the class would not have purchased the flushable wipes … if they knew that flushing the wipes would cause the wipes to become clogged in sewer or septic systems.”
The plaintiff is seeking to represent himself and a Class of all consumers who bought Kirkland Signature brand wipes in the United States.
The Costco Flushable Wipes Class Action Lawsuit is Armstrong v. Costco Wholesale Corporation et al., Case No. 1:15-cv-02909, in the U.S. District Court for the Eastern District of New York.
UPDATE: On Feb. 3, 2017, a New York federal judge transferred this case to the plaintiff’s home state of Oregon.
