NatraBioA nationwide class of homeopathic medicine customers filed a class action lawsuit against Nutraceutical Corporation, alleging that the supplement giant knowingly misleads consumers about the efficacy of its NatraBio® line of homeopathic remedy products.

The homeopathic medicine class action lawsuit, filed by attorney Ronald A. Marron on behalf of plaintiffs Cynthia Hammock, Sherry Bentley and Linda Love, alleges that the NatraBio® homeopathic remedy products, including many popular cold and flu remedies for children, contain hyper-diluted ingredients that are incapable of providing the advertised symptom relief.

“By misrepresenting the efficacy of these cold and flu products, Nutraceutical and other homeopathic drug manufacturers have effectively tricked millions of consumers into purchasing what are essentially sugar pills,” Marron said about the class action lawsuit.

The 65-page complaint filed on Sept. 15 in a California federal court alleges that Nutraceutical and two of its subsidiaries knowingly misleads consumers about the NatraBio® products.

“As a matter of established scientific principle, the NatraBio products cannot possibly be inherently effective at providing relief for any type of symptoms in any human being,” the homeopathic medicine class action lawsuit says. “They work no better than a placebo.”

The nationwide homeopathic remedies class action seeks to deliver reimbursement to consumers who would not have purchased these homeopathic remedy products had they been aware of the truth about the dilution levels of the ingredients, and it also seeks injunctive relief requiring Nutraceutical to end its deceptive marketing.

The NatraBio® homeopathic remedies at issue in this class action lawsuit include Smoking Withdrawal, Leg Cramps, Restless Legs, Cold and Sinus Nasal Spray, Allergy and Sinus, Children’s Cold and Flu, and Flu Relief Spray.

The homoeopathic medicine class action lawsuit accuses Nutraceutical of fraud and violations of the California Unfair Competition Law, Consumers Legal Remedies Act and False Advertising Law.

This homeopathic remedies class action lawsuit comes on the heels of several other class actions accusing homoeopathic remedy makers of consumer fraud.

For example, the case against Standard Homeopathic Company, the maker of the popular Hyland’s brand remedies, concluded a false advertising trial in Los Angeles on Thursday.

On Friday, the jury cleared Standard Homeopathic of breach of warranty charges and allegations that it had violated California’s Consumer Legal Remedies Act.

The court will decide if the Hyland homeopathic medicine maker violated the Unfair Competition Law and False Advertising Law.

Similarly, class action lawsuits are pending against Nature’s Way, makers of the Alpha CF, Boericke & Tafel (B&T) and Umcka brands of homeopathic remedies.

Hyland’s CEO Jay Borneman admitted under oath that his company does not routinely subject the Hyland’s products to clinical trials for efficacy before they are sold to consumers throughout the country.

“Many homeopathic drug manufacturers have failed to uphold their responsibilities to consumers by ensuring that they are placing effective products on the market,” Marron said.

“When parents buy cold or flu remedies for the family, they expect these products to actually provide the advertised symptom relief,” he added.

Individuals who have purchased NatraBio®, or other homeopathic drug products, such Nature’s Way, Umcka, B&T, or Alpha CF, may contact the Law Offices of Ronald A.  Marron by submitting their information via the class action investigation.

The plaintiffs are represented by Ronald Marron.

Counsel information for the defendants is not yet available.

The NatraBio Homeopathic Remedy Class Action Lawsuit is Cynthia Hammock et al. v. Nutramarks Inc. et al., Case No. 3:15-cv-02056, in the U.S. District Court for the Southern District of California.

UPDATE: On Sept. 13, 2016, a California federal judge tossed two of nine claims in a proposed class action lawsuit alleging Nutraceutical falsely advertises its homeopathic supplements.

    This is SO WRONG!!! Natra Bio products have helped me and my family for years, often when Western Medicinals do nothing to help. The people filing this claim obviously know nothing about and do not believe in the efficacy of homeopathics. However, they DO WORK.
    SO, SO SORRY to see the damage you all have and are causing by pushing this product off the shelves and out of our lives. SHAME ON YOU!

    Why do greedy people and more greedy lawyers have to mess things up for others? Many in my family understand how homeopathic products work and are disappointed that the remedies which worked for them are not available anymore.

      What is wrong with people?! Why are people attacking homeopathy companies?! NatraBio has helped my family for years and I’m desperately trying to find the last of its products because it’s the only medication that has helped my family without the bad side affects from other non-natural medications. My family NEEDS this medication and you’re literally messing with our health and lifestyle by killing these companies and their products! I know for a fact that their products work and aren’t just “sugar pills”. If I can’t find an equivalent replacement for the products that the horrible, money hungry, power hungry people stole from my family, what are we supposed to do?! Suffer? Maybe even die? Who will be responsible for that? Cynthia, Sherry, and Linda will be responsible! They are claiming to do “good” by taking down a company that has helped sooo many people with their products! How backwards is that?! I hope I find a replacement for the natural medicine that I’ve lost because of Cynthia, Sherry, and Linda! It’s a good thing I don’t sue people, because I might would go after those three for my family’s medical bills and suffering. I’m literally horribly sick at this moment and looking for the one medicine that actually works on me without causing me other problems, and I can’t find anymore, thanks to those 3 people!

    I am also worried that I cannot buy two NatraBio preparations that are very effective: Arnica Relief and Sinus Relief.

    I am shocked. I have been using a few of these products and they have consistently worked for me. And I am a nurse – one would think I would be more skeptical but I find homeopathics helpful.
