Mesothelioma Asbestos LawsuitA Virginia resident is suing his apartment complex for illegal exposure to asbestos and the subsequent attempt to cover up this exposure by forcing eviction on hundreds of its tenants.

Plaintiff Ray P., who lived in Hunting Point Apartments for twenty years, filed an asbestos lawsuit against the property owners for exposing himself and hundreds of other tenants to asbestos via ongoing construction over a period of four years.

Ray claims that this asbestos exposure could lead to future diagnosis of mesothelioma cancer in either himself or any other tenant. Ray further alleges that the complex, in an attempt to avoid asbestos exposure lawsuits, evicted hundreds of tenants before they may be diagnosed with mesothelioma or other asbestos-related diseases.

Asbestos Allegations Include Cover Up, Malicious Acts

Ray filed the complaint pro se over alleged malicious acts by billionaire developers and federal government officials related to Hunting Point Apartments.

According to asbestos lawsuit, ongoing construction and renovation to the apartment complex beginning in 2012 and continuing at the time of the lawsuit has exposed Ray to life-threatening malignant asbestos mesothelioma lung cancer.

Mesothelioma is a lung cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos. In most cases, the asbestos lawsuit claims, this form of lung cancer results in a very poor prognosis and a high likelihood of fatality.

Ray further argues that this asbestos exposure from construction was done maliciously and with reckless abandonment for his safety as well as the safety of hundreds of others in the complex in a similar situation.

According to the lawsuit, the malicious actions on the part of the developers and government officials included collusion, conspiracy, and an ongoing cover-up that led to gentrification, displacement, and unlawful removal of the plaintiff.

The lawsuit claims that every man, woman, child, and pet in similar circumstances to Mr. Parker were also displaced and involuntarily removed from the 540 units at Hunting Point Apartments.

The asbestos lawsuit further alleges that Hunting Point Apartments began this blanket eviction in order to cover up traces of ongoing exposure to hazardous asbestos and lead paint materials. Ray asserts that the eviction is intended to discourage former tenants from getting involved in asbestos litigation.

The catch 22 of the situation, Ray claims through the asbestos lawsuit, is that the former tenants of Hunting Point Apartments may not develop symptoms from asbestos for several years, and so would not be able to file an asbestos lawsuit against the complex in the allotted two year time frame.

Ray hopes that the asbestos lawsuit will result in the blanket eviction being cancelled, reimbursement of all costs of eviction for those forced out of the complex, and finding gentrification both unconstitutional and in violation of constitutional and civil rights.
