Baby Deaths Lead to $110M Settlement in E-Ferol Case
By Sarah Pierce
A federal judge has approved a $110 million class action settlement against the manufacturer and distributor of E-Ferol — nearly 26 years after dozens of babies died from the intravenous vitamin E supplement.
Art Brender, the attorney representing the class, estimates over 80 babies died in the mid-1980s after being administered E-Ferol, a solution given intravenously to help prevent blindness in premature babies. E-Ferol was never approved by the FDA and was recalled less than five months after hitting the market.
“The manufacturers lied to the hospitals,” said Brender. “It’s one of the worst cases of corporate greed and malfeasance in history.”
The lawsuit was brought on behalf of everyone in the United States who received E-Ferol between November 1, 1983 and April 30, 1984, including the parents, spouses, children and heirs of deceased persons who were administered the drug.
