Unilever, the parent company of Dove, deceptively markets its Men+Care Dove deodorant as being “anti” stain, when in fact it causes white and yellow stains on consumers’ clothes, a new class action lawsuit alleges.

The nationwide class action lawsuit was filed in Missouri on May 20 by lead Plaintiff Peter Fischer, who alleges that Conopco Inc., doing business as Unilever, engages in false and misleading advertising of its “Stain Defense” antiperspirants, despite scientific research proving its claims are wrong.

According to the claim, the deodorant in question is marketed as having a formula that prevents white marks and staining.

However, the active ingredient in the antiperspirant is aluminum, which has been scientifically proven to cause “white marks” and “yellow stains,” the claim states.

It adds that there are other deodorants on the market that do not contain aluminium and can legitimately claim to be anti-stain.

“Stain Defense antiperspirant, despite posing as such, is no such product,” the lawsuit claims. “The product does absolutely nothing to decrease, lessen or reduce stains or white marks, it creates them.”

Fischer says that he bought the deodorant thinking it would stop marks from appearing on his clothing, only to discover shortly thereafter the company’s claims were false.

The class action lawsuit says that Fischer was injured by Unilever’s “deceptive, false, and misleading conduct in marketing and selling the Product.”

“In reality the antiperspirant actually causes the very problems Unilever deceptively claims it is anti towards and prevents,” the claim states.

Despite this, the claim says that Unilever sells the product to the buying public, misleading and deceiving consumers into paying for an inferior product while under the false impression that it has benefits it does not contain.

Fischer wants to represent anyone who purchased the Men+Care Dove deodorant nationwide, and also a subclass of Missouri consumers.

He is suing for breach of warranty, breach of implied contract, and unjust enrichment, and violations of the Missouri Merchandising Practices Act. He seeks certification of the class, damages, restitution, attorneys’ fees, costs, and a jury trial.

Unilever was hit with a similar class action lawsuit in 2019 over a line of women’s antiperspirant alleging the same problem. A customer claimed that Dove’s line of “Invisible” antiperspirant sprays leave white marks, contrary to advertisements.

Earlier this year, Unilever was also hit with a class action lawsuit alleging a Dove body wash marketed as being “microbiome gentle” and containing “skin-natural nourishers” in fact contains multiple ingredients that trigger skin reactions.
