
A class action lawsuit claims America’s Health Center illegally placed telemarketing calls to consumers without their consent.
The lawsuit, filed May 17 in federal court in Florida, alleges the Boca Raton-based company — which describes itself on its website as a “nationwide enrollment center for individuals or families searching for affordable health coverage” — made repeated, unsolicited calls to the two lead plaintiffs on the case, Andrea Audish of Texas and Lisia Hall of Florida, in violation of the Telephone Consumer Protection Act (TCPA).
Both plaintiffs’ telephones are on the National Do Not Call Registry, but nevertheless, America’s Health called Audish twice and Hall no fewer than seven times during April 2021, the lawsuit states, with the intention of selling health insurance policies to both.
Hall even made clear “during multiple calls” that she was not interested, but continued to receive the calls anyway, the class action alleges. Neither of the plaintiffs gave America’s Health prior written consent to receive the telemarketing calls, nor did they have prior communication or a prior relationship with America’s Health.
The plaintiffs are seeking certification of a nationwide Class consisting of anyone whose phone number was on the National Do Not Call Registry, but still received multiple telemarketing calls in a 12-month span from America’s Health at any point in the four years prior to the filing of the lawsuit.
“Plaintiffs and all members of the Class have been harmed by these acts of the Defendant, including, but not limited to, the invasion of their privacy, annoyance, waste of time, the use of their telephone power and network bandwidth, and the intrusion on their telephone that occupied it from receiving legitimate communications,” the lawsuit says.
The exact size of the proposed Class is unknown, but the lawsuit speculates that “at minimum” there are hundreds of consumers who were subjected to illegal calls by the defendant.
The plaintiffs are asking for injunctive relief to prevent America’s Health from making telemarketing calls to phone numbers on the Do Not Call Registry in the future, along with statutory monetary damages of $500 per TCPA violation and $1,500 for each “willful or knowing” violation.

I am getting 6 to 10 calls a day from Americas Health. I am on the do not call list and have asked them repeatedly to stop calling me.
I am being tortured. They called 8 to 10 times daily from different numbers but it’s always the same. They’re calling from america’s health Center or some name similar for selling me add-ons to my Medicare. I am not even 65. I don’t have Medicare sometimes I’ll play along and get a human being and beg them to take me off the list and tell them I’m not even 65 they hang up it’s making me nuts 8 to 10 times a day. I block each number but it always comes from yet another number and I’m on the do not call list but what good does it to me when it comes from a different number each and every time . My daughter says just get a new phone number but that’s impossible. I’ve had this phone number for 25 years.
I receive(d)…and still do, at least 5-10 calls per day for the last 2 years (at least) from Health Advisors or Health Help, at times back to back 3-4 times in 5 mins. I am constantly harassed starting @ 8am until 8pm at least on a daily basis. They fill up my voicemail causing me to miss important calls and messages. When attempting to call back, the # will not go through. Also when trying to explain i have health insurance, they abruptly hang up and call right back. At times, it’s a fake female voice saying “Hello, are you there?” This is harrassment and is torture.
i need to talk to someone i have been getting calls from this company and when i finally said enough is enough and go off on the person she hangs up some dude calls me saying threating me then tells me my address says he will kill my kids and family piss in my dead moms mouth hangs up and is sending me pics of me to my phone from his personal phone and telling me he has me tapped dude dont know who he is really messing with when it comes to my daughter ill go to prison im trying to do this the legal way before i take matters in my own hands 417 205 5997 is my number thanks
I am constantly bombarded with 10 to 12 calls daily claiming to be from American Health Center. I’ve screamed at them, been very nice to them, even pretended to be a family member or friend. I have a business doing DoorDash and as a contract radio engineer. My phone is my business, so these calls are an interruption that interferes with my business. I’m also on the Do Not Call registry.
Im in florida and am currently Nov.25,2024 receiving several calls a day from a place that calls themselves Americas health. They use (941) (727) & (239) area codes and none of the numbers seem to exist except for one. Weird thing is this number has a 941 and 239 area code both to same person. I gave up answering my phone unless I recognize it. Ive missed doctor appointments and other calls because it gets me pretty pissed and im not in the best health.Im on the do mot call registry, Ive asked to be put on their list, I hang up, Ive blocked to no avail just new numbers. I never ask them to call me I choose my own plan using the government website. I never had to call anyone I never had to speak to anyone and how would you call my phone and the message says if you’re trying to sell me something please don’t call me back it’s even on my message they’re pain in the butt and I would like some help to get them stop calling me. It’s always easier if someone text me first and alert me that they’re going to call or tells me to call thank you
