Philips Sonicare AirFloss class action settlementUPDATE 5/12/14: Viewers of Top Class Actions have reported that they have received their settlement checks in the mail! 

A U.S. District Judge has given her final approval to a class action lawsuit settlement resolving allegations that Philips Oral Healthcare Inc. deceptively marketed its Sonicare AirFloss as a replacement for traditional dental floss. Class Members will have until Jan. 20, 2014 to file a claim.

Plaintiffs also alleged that the marketing was unethical because it induced consumers into paying more than $100 for a product that did not adequately remove plaque from teeth while dental floss – which is proven to remove plaque– costs less than $5.

Philips denies any wrongdoing but agreed to the class action settlement to resolve the litigation.

The class action settlement provides relief to consumers who purchased a new Philips Sonicare AirFloss in California between Jan. 1, 2011 and June 24, 2013. There will be three categories of claimants:

(1) Class Members who submit proof of purchase of a new, two-pack AirFloss  will receive a voucher of $33;

(2) Class Members who submit proof of purchase of a new, single-pack AirFloss will receive a voucher for $23; and

(3) Class Members who fail to submit proof of purchase may submit an attestation that they purchased a new AirFloss within the class period. They will receive a voucher for $7.

It should be noted that with final approval granted on Nov. 6, and with no appeal surfacing yet, vouchers may be distributed right after the Claim Deadline. This may change if there are appeals because it is always uncertain when any appeals will be resolved.

Claim Forms and other information on your rights in the Philips Sonicare AirFloss Class Action Lawsuit Settlement can be found at www.PhilipsAirFlossSettlement.com. The only way to  receive a voucher from this class action settlement is to submit a valid Claim Form and proof of purchase (if applicable) postmarked by Jan. 20, 2014. The case is Perkins v. Philips Oral Healthcare Inc., et al., Case No. 12-cv-1414H BGS, U.S. District Court, Southern District of California.
