The Ameriwood Mainstays dresser has been a popular dresser option for years, sold at major retailers across the country, including Walmart.
These dressers were considered a great option, retailing at about $60, but unfortunately, they have been linked with a serious tip over risk. Around 1.6 million Walmart Mainstays dresser units were affected in a recall, announced by the U.S. Consumer Product Safety Commission (CPSC).
The Walmart Mainstays dresser units affected by the recall have four drawers, and come in a variety of colors, including alder, black forest, white, weathered oak, walnut, and ruby red. Do you own one of the dressers included in the recall?
The Walmart Mainstays Dresser Recall
The CPSC noted in their recall announcement that these dressers pose “serious tip-over and entrapment hazards that can result in death or injuries to children” if not anchored to the wall. They further noted that the Walmart Mainstays dresser does not comply with voluntary U.S. industry standard performance requirements. The CPSC reports that at least one child has been injured by a toppling Ameriwood dresser.
Around 1.6 million Walmart Mainstays dresser units were recalled because of these issues in September 2017.
Consumers with a Walmart Mainstays dresser not anchored to the wall have been asked to stop using it, as well as keep children away from it. Ameriwood is offering free repair kits for the affected Ameriwood dresser units. These repair kits include a device to anchor the unit to the wall.
Have you purchased a Walmart Mainstays dresser affected by the recall? If you didn’t get what you paid for–that is, a safe dresser without a heightened tip-over hazard–you may be eligible for compensation.
Furniture Tip-Over Hazards
More and more furniture tip over injuries are being reported, the vast majority of which involve children. The Consumer Product Safety Commission (CPSC) found in 2016 that more than 30,000 Americans visited the emergency room because of furniture tip over injuries. This report sparked a class action investigation into some major furniture companies, which may have failed to take proper precautions in ensuring the safety of consumers.
Those primarily at risk from these kinds of furniture tip over injuries are the most dangerous for children.
The Ameriwood dresser recall is not the only one of its kind. Indeed, over the last several years, a number of dressers have been recalled due to tip-over hazards. Dresser recalls have affected units sold at Ikea, Walmart, Target, Amazon.com, Baby.com, JCPenney, and more.
Compensation for Recalled Dressers
Large furniture prone to tipping over includes dressers, cabinets, and bookshelves. While anchoring furniture to the wall would help prevent these risks, some claim that the manufacturers of this furniture should take responsibility and improve their own standards in order to best protect customers.
Lawsuits allege that the manufacturers of the products involved in furniture tip over injuries should be held responsible for defects, poor manufacture and design, and inadequate safety measures. If you have purchased a Walmart Mainstays dresser affected by the recall, you may be able to join a class action lawsuit investigation and receive compensation.
