Minnesota COVID-19 Test Class Action Lawsuit Overview:

A Minnesota COVID-19 test lab gave people’s test results back much later than promised with false results or not at all, a new lawsuit alleges.
Minnesota’s attorney general filed the lawsuit against the Center for Covid Control (CCC) and its associated clinical lab Jan. 19 in a Minnesota district court, alleging the pair failed to deliver Covid-19 test results or delivered untimely or falsified test results, CNN reports.
Attorney General Keith Ellison said the lawsuit was filed after the Minnesota Department of Health received multiple complaints from those tested for COVID-19 at pop-up sites operated by the company.
While some complaints were from those who got their antigen or PCR results much later than promised, some said they never received their results at all, the lawsuit says.
Others reported receiving results that were “riddled with inaccurate and false information including listing the wrong test type and false dates and times for when samples were collected from consumers,” the lawsuit states.
Some received negative test results when they had not even submitted a sample for testing. The company and lab began offering tests in Minnesota late last fall, the lawsuit states.
CCC To Pause Operations Until Further Notice
Last week, the CCC announced it would pause operations until further notice.
“CCC remains committed to providing the highest level of customer service and diagnostic quality and will not resume collection of patient samples until staffing resources permit CCC to operate at full capacity,” the press release reads.
The pause in operations will be used “to train additional staff on sample collection and handling, customer service and communications best practices, as well as compliance with regulatory guidelines,” the center said.
The lawsuit claims the company violated state consumer protection laws, including instructing employees to tell people who called about late test results that the results were coming in 24 hours even if staff had no idea where the results were.
If people called multiple times, the staff were told to tell the customer that the test result had been inconclusive and that they needed to take another test, the lawsuit alleges.
The lawsuit comes after New Jersey-based laboratory Infinity Diagnostics agreed to a settlement to resolve claims that it distributed fraudulent COVID-19 “rapid blood tests.”
