Illinois residents who scanned their fingerprint at an Octapharma Plasma Center plasma donation facility in Illinois may be eligible for compensation in the form of a payment thanks to a recent $9.9 million class action lawsuit settlement.

Class Members in this class action settlement include individuals who scanned their fingerprints and provided an Illinois address at an Octapharma blood plasma donation facility at any point between Dec. 2, 2014, and Feb. 4, 2020.

Plaintiffs allege Octapharma violated the Illinois Biometric Information Privacy Act (BIPA) by collecting biometric fingerprint data from plasma donors without first providing notice or getting consent. The law prohibits private companies from capturing, obtaining biometric information without notice or consent.

The company denies the allegations laid out by the plaintiffs, and it doesn’t believe BIPA applies to Octapharma. 

The Court did not review the facts surrounding the claims and did not decide which party’s claims were right. Instead, both parties have agreed to end the class action by agreeing to the terms of the proposed settlement agreement.

Back in 2019, Octapharma invested around $900,000 to build out a new business building in Chicago, according to Intelligence360. Nationwide, it employs more than 3,500 Americans and operates at least 80 plasma donation centers. 

Eligible Class Members who file a claim will receive their share of the $9.9 million settlement fund. 

Each Class Member will get an equal share of the fund once all other fees are taken care of. 

While the exact value of this payment has not yet been confirmed by the Court, it’s estimated each eligible Class Member will receive around $400 to $800. This amount may change depending on the number of Class Members who file a claim.

Class Members who do not file a claim will not get their fair share of the Octapharma lawsuit settlement, but they will give up their right to seek out future lawsuits regarding this matter. 

Class Members who want to retain this right must exclude themselves from the Class. 

Class Members may also file an objection if they disagree with the terms of the settlement agreement.

The deadline to opt out of or object to the Octapharma Plasma Center class action lawsuit settlement is Jan. 27, 2022.

A final hearing will take place Feb. 16, 2022.

The deadline to file a claim in this class action settlement is Feb. 3, 2022.

    I spoke with someone regarding the payments. He confirmed that electronic payments were sent out a few weeks ago as several people have reported. However, if you did not get an electronic payment it means that they didn’t have an email address or any way to send it to you. The remaining people will be mailed a check and he said those would go out in the 2-3 weeks. So if you haven’t received anything, sit tight, you should get it soon.
