Infinity Diagnostics agreed to a class action settlement to resolve claims that it distributed fraudulent rapid COVID-19 antibody blood tests.

The settlement benefits New Jersey consumers who received finger-stick COVID-19 antibody blood tests from Infinity Diagnostics since March 1, 2020. The settlement agreement notes there are around 400 potential Class Members included in the deal.

Infinity Diagnostics is a New Jersey-based laboratory that offers diagnostic testing for a wide range of conditions, including COVID-19. Although the company touts its state-of-the-art equipment and stringent hiring qualifications, Infinity Diagnostics allegedly provided fraudulent tests early in the COVID-19 pandemic.

According to legal action against the company, its “rapid blood tests” were fraudulently advertised as able to diagnose active cases of COVID-19. The Food and Drug Administration (FDA) notes antibody blood tests “should not be used to diagnose an active COVID-19 infection” and are only used to detect past infections.

In late 2020, Federal Bureau of Investigation (FBI) agents reportedly raided the laboratory and later released a public service announcement encouraging people to get retested “as soon as possible” if they were tested at Infinity Diagnostic. In its statement, the FBI encouraged people who were tested through finger prick blood tests to contact the bureau. 

The FBI also reiterated the FDA’s stance on blood-prick COVID-19 tests. 

Despite these guidelines, Infinity Diagnostics allegedly marketed its finger-stick antibody blood tests as capable of diagnosing active COVID-19 infections, according to legal action against the company. Consumers say they were deceived into paying for the tests based on false promises and suffered from financial injuries as a result.

Infinity Diagnostics hasn’t admitted any wrongdoing but agreed to resolve the claims from New Jersey plaintiffs with a class action settlement. Settlement documents do not include a total amount for the settlement fund.

Under the settlement, eligible Class Members can receive cash payments of $75 or $37.50. 

The $75 payments are available to Class Members who provide documentation such as payment receipts, test results, or other records supporting their purchase. 

For Class Members without proof, payments of $37.50 are available.

The deadline for exclusion and objection was Dec. 31, 2021. 

The final approval hearing for the COVID-19 blood test settlement is scheduled for Jan. 21, 2022.

In order to receive benefits from the settlement, Class Members must submit a valid claim form by Feb. 12, 2022.
