Are you the owner of a business that takes American Express? You may have lost money because of American Express surcharge rules.

American Express merchant terms prohibit businesses from encouraging customers to use other, less expensive card options and make it difficult or impossible for businesses to pass along credit card processing fees through surcharges. These policies may have cost your business tens of thousands of dollars.

Businesses of all sizes may be able to take legal action through arbitration, a type of dispute resolution that occurs out of court, as dictated by American Express agreements. By participating in arbitration, thousands of business owners could recover between $10,000 and $70,000 if their claims are successful.

Card fee rules: overview

Each credit card issuer has rules about payment processing. When processing thousands of dollars in credit card transactions, merchants can quickly rack up a large amount in processing fees. Some businesses would choose to pass these costs onto consumers through surcharges but American Express makes that difficult or impossible.

In addition to having higher processing fees compared to other card issuers, American Express has strict surcharge rules which limit the ways businesses can use surcharges.

Under American Express merchant terms, business cannot:

  • Imply that they prefer other payment products over American Express cards
  • Dissuade cardmembers from using American Express cards
  • Impose any “restrictions, conditions, disadvantages or fees” on American Express transactions that aren’t imposed equally on other payment products

These terms limit businesses’ ability to place surcharges on consumer transactions that otherwise would help offset transaction fees; therefore this limitation costs average business thousands of dollars a year.

Impact of American Express fees

Unfortunately, the fee policies of American Express may have cost merchants tens of thousands of dollars that they would not have paid in a competitive market.

Under a competitive market, merchants would be free of the American Express limitations and would be able to:

  • Advertise to customers that they could save money by using less expensive cards
  • Negotiate lower fees and other contract terms
  • Ask customers to use business-friendly payment methods to avoid incurring excessive fees
