Owners Insurance agreed to a class action lawsuit settlement to resolve claims that it violated Georgia law by failing to include certain taxes in total loss payments.
The settlement benefits Georgia citizens who were insured under an Owners Insurance auto policy, submitted a claim to Owners Insurance that resulted in a total loss between Jan. 1, 2020, and Aug. 2, 2022, and did not receive at least 6.6% of the actual cash value of the vehicle for title ad valorem tax.
Plaintiffs in the total loss class action lawsuit claim that Owners Insurance violated its insurance contracts by failing to include title ad valorem tax payments on total loss claims in Georgia. Title ad valorem tax is a type of tax levied against motor vehicles.
Owners Insurance is a national insurance company that operates under Auto-Owners and Home-Owners.
Owners Insurance hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum as part of a settlement to resolve the total loss class action lawsuit.
Under the settlement terms, class members can receive up to 100% of the Georgia taxes withheld from their original total loss payments. Exact payments will vary depending on how much claimants are owed in taxes. According to the settlement website, payments are capped at $450 regardless of the amount due in taxes.
The deadline for exclusion and objection is Nov. 20, 2023.
The final approval hearing for the settlement is scheduled for Dec. 8, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Feb. 6, 2024.
