Unum’s Unfair Disability Claim Denial Practices Examined

By Anne Bucher

Unum claim denial tacticsUnum is the largest disability insurance provider in the country. Millions of people rely on the company to protect them in case they become sick, injured or disabled. However, Unum has been accused of using unscrupulous business tactics in order to deny legitimate claims. Their unfair claim denial policies have left thousands of people without disability coverage just when they need it the most.

In many of these cases, the policyholder is no longer able to work because of the disability. Not only are they faced with expensive medical bills, they no longer have employment income to rely on. These policyholders are put in an extremely difficult situation. Even though these policyholders were proactive and purchased disability insurance to protect them, they were subject to unfair disability claim denials.

Unum Routinely Uses Unfair Claim Denial Tactics

According to former Unum employees, Unum sets a monthly quota for disability claim denials and rewards employees who deny the most claims. Employees who complained about the quotas claim that they were retaliated against. Unum relies on the medical evaluation of physicians when determining whether to deny claims. Former Unum physicians claim that they were told to review medical records and declare that policyholders were not disabled, even if the policyholder had a legitimate disability.

These unfair business tactics have led many policyholders and former employees of the company to file lawsuits against the company for their illegal policies. They complain that Unum is motivated by money rather than helping the vulnerable people they promised to serve. Some of Unum’s claim denial tactics include:

  • Improperly investigating disability claims
  • Changing policies after claims are filed without notifying policyholder
  • Improperly reading/interpreting medical records
  • Partial payments
  • Refusal to acknowledge certain types of disabilities
  • Relying on in-house physicians rather than independent doctors
  • Arguing that a disability is a preexisting condition
  • Using investigators to discredit the disability
  • Denying claims without medical examination

Unum’s Illegal Claim Denial Strategies Have Led to Thousands of Lawsuits

These unfair practices have gotten the attention of government agencies, attorneys and the media. In 2002, the television program “60 Minutes” investigated Unum’s questionable business practices. The show featured interviews with former employees, in-house doctors and policyholders whose claims had been denied. Many people have stepped up and filed lawsuits against the company, alleging that Unum routinely engages in unfair and illegal business tactics at the expense of its policyholders. Many of these lawsuits have been resulted in millions of dollars in settlements.
