Unum Lawsuit Ruled in Favor of Plaintiff, Twice

Unum offers disability benefits to those who need them, typically backing employer’s disability plans. The concept of the plan is good; however, many people have experienced difficulties getting their Unum disability insurance claims approved after becoming injured. This is what happened to Unum policy holder Tanya Mondolo after experiencing bone death and fibromyalgia as a result of receiving chemotherapy for leukemia. Because of these conditions she is unable to sit for long periods of time and experiences difficulty walking. Instead of covering her claims, investigating them or following up, Unum denied medical benefits to Mondolo who subsequently sued Unum and won.
Unum Fails to Investigate Properly
According to the court’s decision, Unum not only failed to pay Mondolo’s rightful disability insurance claims, but they also failed to properly investigate the claims themselves. In addition, no investigation was made into appropriate alternate jobs nor was psychological evidence considered. Because of this failure on Unum’s part, the court awarded in Mondolo’s favor and demanded that Unum reinstate her claims with interest. Subsequently, the court advised the attorneys to make a motion for attorney’s fees and awarded Mondolo $119,000 to cover them. Unum disputed the fee amount claiming they should only have to pay $50,000 and that $119,000 was more than double the amount that they typically pay. The court also referred to the company’s conduct as “culpable.”
Unum Claim Denials Typical
While it might seem out of the ordinary to have disability claims denied on perfectly valid cases, Unum has been accused many times of denying or cutting off claims long before they should. Because of this, some disability insurance holders have found themselves facing financial ruin with medical bills they cannot afford.
In the meantime, Unum has reported in their fiscal reports that they are profiting on the disability insurance payments they are receiving. Yet, they are not paying out on legitimate claims. Several Unum fraud lawsuits have been filed by those who claim they were wrongfully denied their disability benefits and are seeking restoration and payment of their claims.

calif comp for the first 90 days! you need to apply asap if you have bills to pay and after that you need to get a disability lawyer you injures are common for a bus driver
I got hurt at work, this was the first time in 43 yrs of working, and the insurance company has prolonged payment to me as well. They are investigating me, as though I have done this on purpose. I have witnesses, I have two tears in rotators cuff, frozen shoulder, neck strain, arm/hand strain. I have never had injuries in any of these areas. All doctors agree with the plan of action. Still I call and ask what is happening w my claim they state they do not need to tell me anything tell 90 days.
Well I have a son to feed I have rent to pay and bills to pay. I have already had to go to the food bank two times. This is not my fault, the insurance company needs to do there job.
I can not work, I am a school bus driver and must have full range of arms/ shoulder/ neck. work said I can not come back tell I am 100%. Doctors say I need surgery, but keep prolonging saying Physical Therapy.
These companies try to claim it is the workers that are ripping off the WComp/ Disability companies, I think they are screaming about the workers so no one will notice it is them ripping off the employee’s and employers. I know I am not the only one this has happened to….probably a class action lawsuit there. I have written to the Ca.Gov Brown 5 times now reporting Keenan and Associates, I will continue.
