Tranzact agreed to pay $296,400 to resolve claims it ran employment consumer reports without providing the required Fair Credit Reporting Act (FCRA) disclosures.Â
The settlement benefits consumers who had an employment background check run related to employment at a call center operated by Willis Towers Watson within the last two years who were denied employment based on the consumer reports despite not receiving the required FCRA copy and summary within five days of adverse action.
According to the background check class action lawsuit, Tranzact failed to provide the disclosures required by the FCRA when running background checks on employees and applicants. Under the FCRA, businesses must provide certain notices and copies of reports to consumers.Â
Tranzact is a marketing company that helps drive sales for insurance companies. The company is part of Willis Towers Watson, a global insurance brokerage.Â
Tranzact hasn’t admitted any wrongdoing but agreed to a $296,400 settlement to resolve the FCRA class action lawsuit.
Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Settlement payments are estimated to be up to $400.
The deadline for exclusion and objection is July 18, 2023.
The final approval hearing for the settlement is scheduled for Aug. 8, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by July 18, 2023.
