Keurig Dr Pepper Overtime Kronos Data Breach Class Action Lawsuit Overview: 

  • Who: Candice Kraemer filed a class action lawsuit against Keurig Dr Pepper.
  • Why: Kraemer claims Keurig Dr Pepper has failed to pay its workers proper overtime or for their hours worked following a December 2021 data breach of the Kronos payroll system it uses. 
  • Where: The class action lawsuit was filed in Massachusetts federal court. 

Keurig Dr. Pepper employees were not paid for their hours worked or proper overtime pay after the company’s Kronos payroll system was hacked last year, a new class action lawsuit alleges. 

Plaintiff Candice Kraemer, a Keurig Dr. Pepper employee, claims the Kronos data breach “led to problems in timekeeping and payroll throughout KDP’s organization.”

Kraemer claims Keurig Dr. Pepper could have “easily implemented” a temporary time-recording system to ensure non-exempt hourly and salaried employees were paid properly while the Kronos hack was being resolved. 

“Instead, (Keurig Dr Pepper) pushed the cost of the Kronos hack onto the most economically vulnerable people in its workforce,” the Keurig Dr Pepper class action states. 

Kraemer argues that Keurig Dr Pepper ultimately “made the economic burden of the Kronos hack fall on frontline workers.”

Keurig Dr Pepper class action alleges company still has not paid all earned wages

While Keurig Dr Pepper did eventually make payments for some wages that were outstanding, there still remains unpaid earned wages, the Keurig Dr Pepper class action alleges. 

Kraemer claims Keurig Dr Pepper is in violation of the Fair Labor Standards Act and New Jersey State Wage and Hour Laws and Wage Payment Laws

Kraemer wants to represent a nationwide class and New Jersey subclass of all current or former non-exempt Keurig Dr Pepper employees who worked for the company since the Kronos data breach on or around Dec. 11, 2021. 

Plaintiff is demanding a jury trial and requesting an award of unpaid wages, liquidated damages and penalties for herself and all class members. 

A similar class action lawsuit was filed this month against Allstate by an employee who claims the insurer failed to pay its workers proper overtime following the Kronos data breach. 

Kronos agreed to pay $15.3 million in February to end claims it failed to comply with Illinois’ biometric privacy laws by collecting the biometric data of its workers without their consent.
