Kaiser Foundation Hospitals agreed to pay over $4 million as part of a settlement resolving a class action lawsuit claiming it failed to use the proper Fair Credit Reporting Act (FCRA) disclosures when running employment background checks.
The settlement benefits individuals who had an employment background check run by Kaiser Foundation Hospitals between Aug. 20, 2016, and Jan. 31, 2022.
According to the plaintiff in the case, Kaiser failed to obtain authorization for background checks through the disclosures required by the FCRA. The class action lawsuit also claims these background checks violated California’s Investigative Consumer Reporting Agencies Act and Consumer Credit Reporting Agencies Act.
Kaiser Foundation Hospitals is a health care system in California. The hospitals are part of the larger Kaiser Permanente group that operates hospitals around the country.
Kaiser hasn’t admitted any wrongdoing but agreed to a settlement totaling more than $4 million to resolve the FCRA class action lawsuit.
Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of participating class members, but each class member is estimated to receive a payment of $64.
The deadline for exclusion and objection is July 31, 2023.
The final approval hearing for the settlement is scheduled for Sept. 21, 2023.
No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment. Class members can update their addresses on the settlement website.Â
