
Goodyear Kronos hack class action lawsuit overview:
- Who: Daren Hull filed a class action lawsuit against Goodyear Tire & Rubber Co.
- Why: Hull claims Goodyear failed to accurately keep track of the hours worked by its non-exempt employees during at least part of a Kronos power outage that began in December 2021.
- Where: The class action lawsuit was filed in Arizona federal court.
Goodyear workers who were not exempt from overtime under federal law were not paid for all their overtime hours worked during and after the onset of a power outage affecting the Kronos timekeeping systems in December 2021, a new class action lawsuit alleges.
Plaintiff Daren Hull claims the Kronos power outage led to non-exempt Goodyear workers either not getting paid all their overtime hours and/or not paid their proper overtime premium on time, if at all, for all their overtime hours worked.
Hull argues Goodyear’s alleged failure to pay its non-exempt workers proper overtime wages on time and in full during the Kronos power outage violated the Fair Labor Standards Act (FLSA).
“Goodyear’s failure to pay overtime to these non-exempt workers constitutes a willful violation of the FLSA,” the Goodyear class action states.
Hull wants to represent a nationwide class of all current or former Goodyear employees who were/are non-exempt and who worked for the company at any time during the Kronos service outage.
Goodyear failed to accurately keep track of hours worked during at least part of Kronos service outage, class action claims
Hull argues Goodyear, for at least a portion of the Kronos service outage, failed to accurately keep track of the hours its non-exempt employees worked.
“As a result of Goodyear’s failure to accurately track the actual hours worked each week, employees who were non-exempt were in many cases paid less than the hours they worked in the workweek, including overtime hours,” the Goodyear class action states.
Hull claims Goodyear was aware of the overtime requirements of the FLSA but still “failed to pay the full overtime premium owed to certain non-exempt hourly and salaried employees, such as Hull.”
Plaintiff is demanding a jury trial and requesting an award of all unpaid wages and liquidated damages and penalties for himself and all class members.
In another case involving Kronos, the software company agreed to pay $6 million last month to resolve claims it failed to protect consumer information during the 2021 data breach against its Kronos private cloud.
