Charlotte, North Carolina, agreed to a $2.17 million class action settlement to resolve claims it wrongfully deducted funds from weekly salaries to support an unauthorized pledge fund.

The settlement benefits Charlotte-Mecklenburg employees who had a payroll deduction taken from their paycheck(s) to participate in the pledge fund on or after March 16, 2011, and who did not receive a payout from the fund upon a qualifying separating event.

Plaintiffs in the class action lawsuit challenged the Charlotte-Mecklenburg Volunteer Police Pledge Fund which required city employees to contribute $5 per week or $260 per year to a fund that would result in payments to the estates of deceased police officers or other retired employees of the police department. This allegedly unauthorized fund failed, the plaintiffs contend, resulting in employees failing to receive the benefits they were promised.

The Charlotte-Mecklenburg Police Department serves Charlotte, North Carolina, and the surrounding communities. 

Charlotte hasn’t admitted any wrongdoing but agreed to pay $1.99 million to resolve these claims. An additional $174,173 from the Charlotte-Mecklenburg Pledge Fund brings the total settlement amount to $2,173,173.

Under the terms of the Charlotte-Mecklenburg Volunteer Police Pledge Fund settlement, class members can receive a proportional share of the net settlement fund. 

Exact payment amounts will vary depending on the amount each class member paid in pledge fund deductions from their pay. No payment estimates are available. 

The deadline for exclusion and objection is March 7, 2023.

The final approval hearing for the settlement is scheduled for April 3, 2023.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive settlement benefits.
