Marriott International Inc. and the Office of the Attorney General of the State of New York have reached a settlement ending class action lawsuit against the hotel company, claiming it did not provide a proper employee severance package at the New York Marriott Marquis Hotel when employees were placed on furlough and then laid off during the COVID-19 pandemic.
Marriott International Inc. has agreed to pay employees their original Marriott severance package and has allocated an additional $2.95 million to further compensate employees.
The Marriott employee severance class action lawsuit settlement provides multiple benefits to Marriott Marquis employees — both those who were offered severance and did not take it as well as those who did take severance payments that were offered under the Marriott International Inc. Severance Plan in March or April 2021.
Employees who were offered a Marriott severance package in March or April 2021 but did not take it are eligible to receive up to two kinds of severance pay under the class action settlement.
Those employees are eligible to receive the full amount that they were offered in the form of a lump sum payment (the “Marriott Severance Payment”).
Some of these employees — supervisors and managers — may also eligible to receive additional severance in the form of a lump sum, to increase the amount of severance compensation they can receive (the “OAG Settlement Payment”), if their Marriott Severance Payment.
Employees who accepted severance pay offered in March or April 2021 under the Marriott Severance Payment are eligible to receive an additional payment in the form of a lump sum, to increase the amount of severance compensation they can receive (the “OAG Settlement Payment”).
The Office of the Attorney General’s lawsuit against Marriott International Inc. stated the company failed to pay sufficient severance to Marriott Marquis employees whose employment was terminated during the COVID-19 pandemic.
The company allegedly furloughed over 1,000 employees, and paid them a week of disaster pay and medical benefits. The Office of the Attorney General says around Dec. 9, 2020, during the pandemic, Marriott laid off more than 800 of these employees. In the case of some managers and supervisors, the hotel company allegedly did not pay them as much severance pay as was promised.
In addition to paying affected employees their original severance payments, the company has agreed to pay affected employees additional severance, up to $2.95 million total.
The deadline to sign the release of litigation rights and receive both the Marriott and the OAG settlement payments is July 22, 2022.
The deadline to sign the release of litigation rights and receive just the OAG settlement payment is May 23, 2023, but the attorney general’s office encourages class members to return their forms as soon as possible. Class members who do not sign, date and return a release will have their OAG Settlement Payment deposited with the New York comptroller as unclaimed funds.

What about people in Oregon, they didn’t even get any pandemic pay, or front line worker pay for any of there security officers that kept Marriott’s properties safe and all
This was a COMPANY wide decision and ALL Marriotts should have been included! We were forced to take pay cuts up to 60% for weeks and then when offered severance it was significantly lower than what we were originally contracted to receive. It’s horrendous.
