Pacesetter agreed to a $90,400 settlement to resolve claims it collected biometric data — employee fingerprints — for timekeeping purposes without getting consent or providing the required disclosures.
The settlement benefits individuals who were required to provide their fingerprints or other biometric information in Illinois to Pacesetter for timekeeping purposes between March 19, 2016, and March 30, 2021.
According to plaintiffs in the biometric privacy class action lawsuit, Pacesetter failed to provide the required disclosure and get informed consent before collecting employee biometrics for timekeeping. Workers in the case claim that Pacesetter did not follow requirements under Illinois’ Biometric Information Privacy Act (BIPA).
Pacesetter is a steel product supplier that serves the HVAC, refrigeration, agriculture, electrical and energy industries. The company operates a service center in Chicago.
Pacesetter hasn’t admitted any wrongdoing but agreed to a $90,400 class action settlement to resolve these allegations.
Under the terms of the Pacesetter settlement, class members can receive an equal share of the net settlement fund.
Exact payment amounts will vary depending on the number of participating class members, but each class member is estimated to receive at least $352.11.
The deadline for exclusion and objection is March 21, 2023.
The final approval hearing for the settlement is scheduled for April 20, 2023.
No claim form is required to receive settlement benefits. Class members may request an electronic payment or update their address information on the settlement website.
