Atlantic Express agreed to pay $200,000 to resolve claims it violated California labor laws at its Los Angeles location.
The settlement benefits hourly, non-exempt employees of Los Angeles Atlantic Express between Feb. 11, 2017, and Feb. 11, 2022.
Atlantic Express is a logistics and courier service that operates around the world. The company has a number of locations, including an office based in Los Angeles.
According to a class action lawsuit, Atlantic Express Los Angeles violated California law by failing to pay its workers the wages and overtime they were owed. In addition, the company allegedly failed to provide mail and rest breaks, failed to issue accurate wage statements and failed to pay all wages owed upon termination.
The plaintiff in the case argued these actions violated California labor laws, some of the strictest wage-and-hour laws in the country. Under California law, workers are entitled to minimum wage, overtime wages, double time and numerous other benefits. According to the plaintiff, he and the class are entitled to back wages and other benefits under these laws.
The wage-and-hour class action lawsuit also includes claims under California’s Private Attorneys General Act (PAGA). PAGA allows workers to take legal action on behalf of themselves and the state’s labor authority and allows workers to seek penalty payments.
Atlantic Express Los Angeles hasn’t admitted any wrongdoing but agreed to resolve these California labor law allegations with a $200,000 class action settlement.
Under the terms of the settlement, class members can receive a cash payment based on the number of workweeks they worked during the class period.Â
Class members can view the number of workweeks they have been allocated on their mailed settlement notice. Exact payment amounts will vary with each class member receiving a proportional share of the net settlement fund based on their workweeks worked.
The settlement also includes a $3,750 payment to the California Labor and Workforce Development Agency under PAGA.Â
The deadline for exclusion and objection is Nov. 8, 2022.Â
The final approval hearing for the Atlantic Express Los Angeles settlement is scheduled for Dec. 19, 2022.
No claim form is required to benefit from the settlement. However, if class members wish to dispute the number of workweeks listed on their mailed notice, they can do so until Nov. 8, 2022.Â
Class members who do not exclude themselves or dispute their workweeks will receive settlement benefits based on the information listed in their notices.
