Tigers Global Logistics agreed to a $270,000 settlement to resolve claims it violated California labor laws when paying non-exempt Avent Group Inc. employees.

The settlement benefits non-exempt employees of Avent Group in California who were assigned to work for Tigers (USA) Global Logistics Inc. between Oct. 3, 2015, and March 15, 2021. The settlement also includes a subclass of Private Attorneys General Act (PAGA) employees who worked for Avent and were assigned to work for Tigers between Aug. 30, 2018, and March 15, 2021.

Tigers Global Logistics provides global supply-chain, technology and freight-forwarding services to a number of companies in California. Avent Group is a staffing company that provides non-exempt, hourly employees to work with Tigers in various roles.

According to a 2019 class action lawsuit, TigersGlobal Logistics violated several California labor laws when paying Avent employees.

The plaintiff in the case claims Tigers failed to pay minimum wage and overtime wage, denied employees rest and meal break periods, failed to pay wages in a timely fashion and provided inaccurate wage statements.

The wage-and-hour class action lawsuit sought relief under California wage-and-hour laws, including PAGA, a state law allowing employees to take legal action on behalf of California’s labor authority.

Tigers hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $270,000 settlement; $60,000 of this settlement total is a PAGA penalty.

Under the terms of the settlement, class members can collect a cash payment based on the number of weeks they worked during the class period. According to the settlement agreement, class members worked a total estimated 24,552 work weeks eligible for payment under the settlement. Class members will receive a settlement payment proportional to their share of that total.

The $60,000 PAGA penalty will be used to pay the California Labor and Workforce Development Agency and PAGA class members; 75%, or $45,000, will be used to pay penalties to the labor agency, while the remaining 25% or $15,000 will be used to fund payments to PAGA class members. The settlement estimates each PAGA class member will receive an estimated $45.87 as their share of this penalty.

The deadline for exclusion and objection is Oct. 31, 2022.

The final approval hearing for the Tigers Global Logistics settlement is scheduled for Dec. 12, 2022.

In order to receive a payment from the settlement, class members must submit a valid claim form by Oct. 31, 2022.
