Carolina First Bank has agreed to pay $450,000 to resolve claims that it discriminated against African American job applicants.
The settlement will benefit African American individuals who applied for a job at Carolina First Bank between April 29, 2010 and April 30, 2011 but did not advance in the hiring process due to information related to credit history.
In February 2011, plaintiff Regina Robinson filed a charge of discrimination against Carolina First Bank, and its predecessor in interest TD Bank, with the U.S. Equal Employment Opportunity Commission (EEOC).
Robinson claimed that Carolina First Bank discriminated against African American applicants through their credit check practices – an alleged violation of Title VII of the Civil Rights Act of 1964.
In October 2011, the EEOC dismissed the complaint but months later in January 2012 the EEOC reconsidered and revoked the dismissal.
In January 2015, the EEOC determined that there was sufficient evidence to support a conclusion the Carolina First Bank’s credit check practices had a “disparate impact” on African American applicants through April 30, 2011. Over the next several years, Robinson and TD Bank participated in mediations to reach a settlement.
Class Members have the potential to recover thousands of dollars from the Carolina First Bank settlement.
If Class Members were employed at the time of their job application, they can recover a flat payment of $2,500. Those who were unemployed at the time of their job application, may be able to recover $1,000 for each month of unemployment with a maximum payment of $25,000.
Any payment recovered through the settlement will be reported on a W-2 as wages, for tax purposes.
The deadline for excluding oneself from the settlement or objecting to any part of the settlement is April 26, 2019. The final approval hearing is scheduled for June 18, 2019.
Who’s Eligible
African American individuals who applied for a job at Carolina First Bank between April 29 2010 and April 30, 2011 but did not advance in the hiring process due to information related to credit history.
Potential Award
$2,500 payment for Class Members who were employed at the time of their application and $1,000 for each month of unemployment for Class Members who were not employed at the time of their application (up to a maximum of $25,000).
