Businessman handing a paycheckComcast and one of their cable installation contractors, O.C. Communications, have agreed to a $7.5 million settlement to resolve a lawsuit lodged by 4,500 technicians and workers.

Comcast Wage and Hour Lawsuit

This California wage and hour lawsuit alleged that Comcast and O.C. Communications violated workplace regulations and protections instituted by California labor laws and the Fair Labor Standards Act. The workers claim in their class action lawsuit that they were not appropriately compensated for their regular hours worked, as well as their overtime hours. They additionally claim that they were denied proper rest and lunch breaks.

Despite agreeing to the settlement, neither Comcast nor O.C. Communications has admitted to any wrong-doing.

Comcast Lawsuit Allegations

The class action suit against Comcast and O.C. Communications makes many claims regarding worker treatment and payment. According to the Philadelphia Inquirer, one of the lead plaintiffs in the wage and hour lawsuit said in a statement to the court, “I was directed by my supervisor to work through meal periods, regardless of what I was required to write on my time sheets.”

The lawsuit’s additional claims include:

  • That workers often faced pressure to under report the amount of hours they worked
  • That workers were pressured to report they had taken meal or rest breaks when they had not
  • That workers were pressured to work through breaks or were prevented from taking breaks
  • That workers’ time cards were manipulated after they had been submitted
  • That workers were not reimbursed for necessary costs associated with the job, and in some cases were required to buy their own tools

What is the Fair Labor Standards Act?

The FLSA establishes minimum wage requirements, as well as requirements for overtime pay, recordkeeping, and child labor standards. The U.S. Department of Labor enforces the FLSA and ensures that companies follow the regulations.

According to the FLSA, nonexempt workers are entitled to receive a minimum wage of $7.25 an hour. Covered workers are also entitled to overtime pay of at least one and one half times their regular rate of pay. Workers are also entitled to receive pay for every hour that they work.

Who Else May Be Affected?

Workers who have evidence that their employers failed to pay them for all hours worked, refused to pay overtime, pressured them to falsify time cards, pressured them into skipping rest and lunch breaks, or violated the FLSA or wage and hour laws in other ways may be eligible to join a class action lawsuit or investigation and pursue rightful compensation for their work.

Employees may be able to recoup their withheld wages, as well as pursuing additional compensation and damages. It may be helpful for employees to keep records of their actual hours worked, as well as records of the hours they were paid for working.
