Two Former Team Enterprises Promotional Specialists Allege Serious California Wage and Hour ClaimsTwo former Promotional Specialists for Team Enterprises LLC are alleging serious California wage and hour claims in a conjointly filed lawsuit, stating the company did not pay them and other employees their full wages.

The California wage and hour claims lawsuit alleges Team Enterprises did not pay them and other employees for all hours worked, which prompted the women to file this class action lawsuit.

Plaintiffs Felicia C. and Alexis W. allege similar California wage and hour claims in their experiences, with both of them working for the company from 2013 to 2017. During this period, Felicia and Alexis were allegedly misclassified as exempt from the California minimum wage benefits including overtime and compensation for any work-related expenses.

The California wage and hour claims allege that Felicia, Alexis, and other promotional workers had to work long hours without being provided meal breaks or rest periods. While the company did pay Promotional Specialists on an hourly basis during promotional events, the claimants allege that Team Enterprises paid below minimum wage for certain tasks.

In addition, Team Enterprises required Promotional Specialists to arrive events at least 15 minutes early and perform work after the events ended. The company allegedly failed to pay them for this time, and only paid them a flat sum of $5 for certain tasks that took a long time to complete.

Overview of California Wage and Hour Policy

The California minimum wage rate is currently $11, which is supposed to increase by one and a half times for non exempt minimum wage employees.

In order for employers to classify workers as exempt from minimum wage, the worker in question must meet certain requirements, such as a certain salary level and exercise of authority over other employees. For example, they must have the ability to hire, fire, or promote other employees and must also have administrative duties.

Felicia, Alexis, and other Promotional Specialists reportedly did not meet these requirements, but Team Enterprises still classified them as exempt.

Under California labor laws, non exempt employees must be paid one and a half times their hourly rate if they work over 40 hours in a single work week or over eight hours in a single work day. In addition, employees must be provided a 30 minute meal break every five hours and a 10 minute rest period every four hours.

During the meal break, the employee must be able to leave the work premises and must not be provided any occupational duties. Employees who are forced to work through their meal breaks, must be compensated an extra hour of pay.

California labor law also states that employees are prohibited from working off the clock, and must be properly compensated for any extra tasks that were performed before or after their shifts were supposed to end.

Team Enterprises allegedly failed to pay any of their Promotional Specialists overtime or compensated for missing meal breaks, which eventually spurred Felicia and Alexis to file this California wage and hour class action lawsuit.

Felicia and Alexis are seeking compensation for all California wage and hour claims for missing wages, denied overtime, missed meal breaks and other payments on behalf of themselves and other similarly situated employees.

This California Wage and Hour Class Action Lawsuit is Case No. 3:18-cv-06867-LB, in the U.S. District Court of Northern California.
