$718K TBJ Drywall & Taping class action settlement

The Illinois attorney general reached a $718,000 settlement with TBJ Drywall to resolve claims it failed to pay workers premium overtime.

The TBJ Drywall & Taping settlement benefits individuals who worked for TBJ Drywall & Taping Inc. in Illinois between Jan. 1, 2018, and July 31, 2023.

According to the Illinois attorney general, TBJ Drywall refused to pay its workers the premium overtime wages they were owed and even misclassified some of them as independent contractors to deny them benefits. These policies allegedly violated various Illinois labor laws including the Illinois Minimum Wage Law and Employee Classification Act.

TBJ Drywall & Taping is a painting and interior finishing company in the Chicago area.

The company will pay $718,000 to resolve the lawsuit. TBJ Drywall has not admitted any wrongdoing by agreeing to this settlement.

Under the terms of the TBJ Drywall & Taping settlement, class members can receive a cash payment based on the overtime wages they are owed that have not been paid. Class members received payment estimates with their settlement notice mailings. These estimates were calculated using employment data on file.

Class members will receive their compensation in multiple payments. TBJ Drywall will fulfill the $718,000 settlement agreement in five installments between Oct. 4, 2024, and April 10, 2018. Claimants will receive payments on or around each of these installment payment dates, assuming they have already filed a valid claim form. 

There is no exclusion or objection deadline for this settlement.

The settlement was approved through a consent decree on Sept. 9, 2024.

To receive all five payments from the settlement, class members must submit a valid claim form by Nov. 16, 2024. Class members may file a late claim through Jan. 11, 2028, but will only receive payments scheduled after their filing dates.
