A federal indictment accuses a partner of Pillsbury Mills of improperly removing asbestos from a plant during demolition, which may have placed workers at risk of asbestos cancer.
The federal indictment alleges that the partner, Joseph C., violated the Clean Air Act in a manner that may have exposed workers to asbestos cancer, and also made false statements in a separate court document.
Each count calls for a penalty of up to five years in prison and three years of supervised release. Each count also carries with it a fine of somewhere up to $250,000.
According to the indictment, in Joseph C.’s capacity as a partner with Pillsbury Mills, he hired an unqualified person to remove a huge chunk of asbestos-containing pipe insulation, amounting to more than 1,000 feet.
The asbestos pipe insulation spanned four buildings, and the project lasted between October 2014 and August 2015.
The indictment states that hiring an untrained and unqualified person to do this work was illegal, violating the Clean Air Act meant to protect people from asbestos exposure and subsequent asbestos cancer risk.
Hiring this unqualified person to do this work led to extremely dangerous asbestos exposure issues. “The asbestos debris was stuffed into approximately 300 garbage bags and at least two open-topped cardboard boxes, and left inside vacant buildings at the facility,” said the indictment announcement.
The last owner of the site closed the facility in 2001, and it has since remained a vacant site and plant.
The indictment also claims that, in a previous lawsuit over the demolition and insufficient cleanup by the request of the Illinois Environmental Protection Agency, Joseph C. claimed to not know who was responsible for this illegal asbestos removal, despite having hired the worker.
On top of claiming to not know who the worker was, Joseph C. allegedly also false claimed that he was not responsible for hiring this untrained worker, and that somebody else was at fault.
Joseph C.’s arraignment is currently set for June 7.
Asbestos Cancer Risk
