Car rental company Hertz has agreed to pay $200,000 cash to settle a nearly $48 million class action lawsuit filed in 2019 by a former employee who claimed they had not been paid for working overtime.
The recent agreement is part of a larger $7.1 million settlement involving this case and four other similar class action lawsuits, according to Law360: one in Florida and three in California.
In the original complaint, the plaintiff, Polat K., claimed he regularly worked more than 40 hours in a week — typically between 50 and 60 hours — and was never paid for any of those overtime hours, in violation of the New York Labor Law.
Polat was employed with Hertz in New York City between May 2013 and October 2015.
The parties filed court documents May 24, 2021, requesting the Court to dismiss the 2019 Hertz class action lawsuit, saying mediation efforts during the spring had been successful.
The Court had issued a stay in the case on May 29, 2020, after Hertz began bankruptcy proceedings.
Mediation in the case began Feb. 19, 2021, according to court documents, and the parties came to an agreement March 24, 2021.
A bankruptcy Court approved the settlement April 13, 2021.
As part of the settlement agreement, the parties stipulated to dismiss the original action filed in district court.

The Hertz Unpaid Overtime Class Action Lawsuit is Polat K. v. The Hertz Corp., et al., Case No. 1:19-cv-05461, in the U.S. District Court for the Southern District of New York.
