Walmart Slapped With Class Action Lawsuit for Paying Worker Too Infrequently

A Walmart in New York should have been paying its maintenance worker weekly for the 18 years she worked there, but instead it paid her bi-weekly, a new labor class action lawsuit alleges.

Plaintiff Raouf Hanna Sharoubim filed the class action lawsuit against Wal-Mart Associates, Inc. Monday in a New York federal court, alleging the retail giant has violated New York Labor Laws.

Sharoubim says she was employed by Walmart as an hourly-paid maintenance worker at its store in East Setauket from about 2003 to January this year.

She says she was a “manual worker” within the meaning of New York’s Labor Law (NYLL), as over 25 percent of her duties were physical tasks, including cleaning, stripping and waxing the floor, cleaning and maintaining the inside and outside of the store and standing for long periods of time. 

However, Sharoubim says Walmart failed to pay her “on a weekly basis and not later than seven calendar days after the end of the week in which the wages are earned,” which the class action lawsuit says is required by New York labor laws.

“Instead, Defendant paid Plaintiff on a bi-weekly pursuant to its payroll policy in violation of New York Labor Law § 191,” the claim states.

“Due to Defendant’s violations of the NYLL, Plaintiff is entitled to recover from Defendant the amount of his untimely paid wages as liquidated damages, reasonable attorneys’ fees and costs, and pre-judgment and post-judgment interest as provided for by NYLL § 198.” 

Sharoubim is looking to represent all others similarly affected and is seeking injunctive and declaratory relief, compensatory damages, liquidated damages, punitive damages, attorneys’ fees and other appropriate relief.

The consumer goods, food produce and retail corporation has found itself facing a range of consumer backlash regarding improper company practices, employment discrimination, and more, which have resulted in a range of class action lawsuits being filed.

    Came across this law a few weeks ago and I agree we are manual labor workers 100% . Iam very surprised at with Wal-Mart as big as it is of how many laws they are allowed to break. Obviously the New York State knows we get paid every two weeks we have to pay taxes before we even get our paycheck. So why let it happen why do we the little ants in these Company have to file a lawsuit for a law that the state is 100% well aware of?? We didn’t make up the law. So yea I been with co.pay 4 years. I would like what iam owed. And there are alot more lawsuit cases that can be available…
    Wal-Mart has to slow down and get it together.
