The United Parcel Service (UPS) has repeatedly denied insurance claims related to the loss or damage of things of value after they were entrusted to the company, a new class action lawsuit alleges.
Plaintiff John Chris Kotsis claims UPS falsely represents that it will provide insurance coverage for things of value that it ships, before later maintaining that the items — gold coins, in his case — are not covered under its terms and conditions.
The plaintiff argues the terms and conditions cited by UPS when allegedly denying insurance claims are “excessively complex and impenetrable” to the point that the company’s own workers don’t understand them and that they cannot be effectively communicated to consumers.
“UPS’s website lists hundreds of pages of ‘terms and conditions’ that describe, among other things, what claims UPS will dishonor,” the UPS class action states. “Not even UPS’s agents knew why gold coins were not insured. How could a mere customer be made aware of this?”
The plaintiff wants to represent a nationwide class of consumers who have shipped a package with UPS that was lost or damaged and who were subsequently denied an insurance claim made to the company.
UPS does not reimburse fees to customers who have shipped items damaged, lost, class action says
The plaintiff argues UPS also declines to repay any of the option fees or other fees it collects from customers for shipments that end up getting lost or being damaged.
“UPS should not be allowed to collect payments for services it does not perform, and charge fees to customers for promises to reimburse them for losses UPS never intends to honor,” the UPS class action states.
The plaintiff claims UPS is guilty of breach of contract, fraud, negligence and unfair or deceptive trade practices under the Federal Trade Commission Act.
Plaintiff is demanding a jury trial and requesting an award of punitive damages for himself and all class members.
UPS workers reached a tentative agreement with the Teamsters union last month to install air conditioning systems in the company’s brown delivery trucks.

Going rounds with UPS over their latest screw up. Their story changed multiple time. First admitted to dropping the package, near point of delivery. Then it was supposed to be returned to me but never was. Then the “investigation” claimed the package was empty. This was a very large although not terribly heavy package for the size. Denied claim for “insufficient packaging” I spent 5 hours on this package and nearly 300 yards of tape beyond multiple boxes and much packing material. Appealed and “approved” but story changes again: Submit docs. Website won’t work. No fax number given. Beyond frustrated and hoping to get in on this lawsuit. UPS is absolutely the wort of the major carriers. Never had issues like this with USPS or FedEx while it’s been an absolute struggle with UPS every single time.
UPS is crooked claimed my item was not packaged properly. Then after the same picture was reviewed they changed that story. And awarded the claim but won’t pay the full claim of 1200. According to them they don’t pay for more than 1000 on claims. Under 5000 insurance. And they want to take the parcel hey if I insure it for 1200 and it’s only worth 100 to someone else. But 1000 to me. Your responsibility that I paid for is to be careful with my package if you break it you bought it otherwise why are you charging people. Ps 1900 gaming pc they dropped now won’t work and won’t pay full claim I will let them pick up what they broke and what they paid for. But the rest I will be removing from it
I paid to insure an item for $1500 through UPS, they stated it was delivered at address, but it was NOT. RING camera proved there was no delivery during time stated by UPS. After contacting Store and UPS, they stated the item was delivered at the Managers’ office. There is no managers’ office on this development. they denied claim. Dealing with UPS store owner where we paid to get the item insured. it has been weeks. No resolution. It appears that this is common issue according to UPS Store employee.
I am an attorney. I believe UPS is potentially involved in deceptive trade practices. My packaged was damaged. They asked me to contact the store where it was shipped. I was told to file a claim. I submitted the claim, with pictures and all the requested documentation. Then they asked for documentation that was difficult to provide months later. Then they informed me that the claim was being turned over to an adjuster. The adjuster then asked for all the same information be provided in the same portal where I began. Except now my tracking number is no longer valid and there’s no way to move through the portal without this.
The Name Ups is a abandon trade mark which may have new owner,any lawsuit with name UPS is( fraud) These Companys and several more corporations have illegal operated these illegal way years
How do I join the class @ctiin suit v UPS for not reimbursing for lost items even though they insured the item(gift cards)?
How do we join this lawsuit or start another one? I have had two packages damaged by UPS in the past couple of months. They refuse to take responsibility.
Shipped a OOAK Hand-Painted Furniture piece, shipping materials/packing were BOMB-PROOF & have many photos documenting that. Even buyer said it was very well wrapped. UPS busted it to pieces. Was insured for $1200, sent tons of pix to UPS, who ADMITTED LIABILITY in an email, but now refuse to pay the claim. I need to find an Atty to handle this, ideally a Class Action suit against UPS I can join. Hoping this website isn’t yet another waste of my time.
