Zenwise class action lawsuit overview:

A Zenwise class action lawsuit claims the company’s over-the-counter Digestive Enzymes and No Bloat supplements don’t actually provide the advertised relief.

Plaintiff Carol Scott says she purchased Zenwise supplements after reviewing marketing materials and other representations indicating the products contained ingredients to provide quick relief from gas and bloating.

However, she says she experienced no relief from the Zenwise supplements because the products do not contain any ingredients that are effective at treating gas and bloating.

The digestive enzymes supplements include a label indicating they are “FAST ACTING PROBIOTICS” and “Clinically Proven Works in Hours,” the Zenwise class action lawsuit states. The Zenwise No Bloat supplement label makes similar claims.

A medical expert hired by Scott’s legal counsel determined the Zenwise supplements do not contain clinically proven ingredients capable of providing quick gas and bloating relief. 

Probiotics are beneficial bacteria or yeast that can balance natural bacteria in the gut, ultimately helping with gastrointestinal health and the immune system. They are not an immediate solution for any health conditions and any benefits “will arise gradually over time and may not even be noticeable,” the Zenwise class action says.

Zenwise class action says company intended consumers to rely on deceptive labeling

Gas and bloating are common ailments, Scott says. Bloating reportedly affects between 10-30% of people and is often accompanied by excessive gas, according to the Zenwise class action lawsuit. 

Most people never seek medical care for their symptoms for various reasons, and many opt for over-the-counter remedies, the lawsuit argues.

“And in response, a whole cottage industry has emerged – offering up over-the-counter solutions that claim to alleviate gas and bloating,” the Zenwise class action lawsuit says. “The products have been highly lucrative, with the digestive health supplements market reaching approximately $16.5 billion in the U.S. in 2022.”

Scott claims Zenwise failed to disclose its supplements did not contain clinically proven ingredients and intended for customers to rely on its labeling and marketing to make their decisions.

She says she would not have purchased the Zenwise supplements, or would not have paid as much for them, had she known they do not perform as advertised.

The Zenwise class action lawsuit asserts claims for violations of California’s Unfair Competition Law, Consumers Legal Remedies Act, False Advertising Law, fraud, fraudulent inducement, fraudulent misrepresentation, breach of express warranty, breach of implied warranty and unjust enrichment.

Several other false advertising class action lawsuits have recently been filed against companies including Panera, Big Heart Pet Brands, Prime Hydration LLC, Philip Morris International and others.
