PC Richard & Son Receipt ViolationsA proposed class action lawsuit accuses appliance and electronics giant PC Richard & Son of making customers vulnerable for identity theft and credit card fraud by printing prohibited information on their transaction receipts.

PC Richard & Son is the largest chain of private, family-owned appliance, television, electronics, and mattress stores in the United States.

These alleged PC Richard & Son receipt violations fall under the Fair and Accurate Credit Transactions Act, which strictly mandates merchants truncate customers’ card numbers and expiration dates on printed receipts.

The Fair and Accurate Credit Transactions Act, or simply the FACTA Act, was enacted in 2003 and provides that “no person that accepts credit cards or debit cards for the transaction of business shall print…the expiration date upon any receipt provided to the cardholder at the point of the sale or transaction.”

The law gave merchants who accept credit and or debit cards up to three years to comply with its requirements, requiring full compliance with its provisions no later than December 2006.

Alleged PC Richard & Son Receipt Violations

Plaintiffs Kathleen O’Shea and Sandeep Trisal, both from New York, brought forth the PC Richard & Son receipt violations complaint, claiming the company knew its receipt printing equipment was not FACTA compliant.

The PC Richard & Son receipt violations class action lawsuit contends that while the company had up to three years to comply, they willfully violated this law and failed to protect the plaintiffs and other consumers against identity theft and debit card fraud by printing the expiration date of the card and the last four digits of the card number on receipts provided to cardholders.

Moreover, the complaint alleges that although O’Shea’s attorneys sent PC Richard & Son a letter prior to the filing of the PC Richard & Son receipt violations lawsuit, requesting they cease and desist their purported FACTA violations, the company continued to commit receipt violations until at least August of 2016.

“Despite knowing and being repeatedly informed about FACTA and the importance of truncating credit and debit card numbers and preventing the printing of expiration dates on receipts, and despite having had over three years to comply with FACTA’s requirements, defendants knowingly willfully, intentionally and recklessly violated FACTA’s requirements,” O’Shea states.

Similarly, Trisal says he experienced PC Richard & Son receipt violations first hand when he received a credit/debit card receipt on May 2, 2016 which contained, among other things, his card’s expiration date and the last four digits of his card number.

The one-count complaint for violation of FACTA seeks to certify a class of all consumers who were provided receipts with the expiration date of their debit card within two years of the filing of the current PC Richard & Son receipt violations lawsuit.

The plaintiffs are asking for an award of statutory and punitive damages, payment of reasonable costs and attorneys’ fees, and any other relief the court deems appropriate.
