Walmart app on phoneA class action lawsuit claims that Walmart misleads consumers by advertising prices on its online app that are lower than those offered in stores.

Plaintiff Sofia Maynez says she used Walmart’s app to view prices of items, which she then purchased in-store.

According to the Walmart class action, she viewed Huggies Wipes as advertised for $5.44 on the Walmart app, and Huggies Pull Ups advertised at $8.97 on the app. 

However, when the plaintiff says that when she went to purchase the items in-store, she paid $12.54 for the Huggies Wipes, and $31.84 for the Huggies Pull Ups.

According to Maynez, she paid $29.97 more for the two items in-store than she would have if they were sold for the prices offered on the Walmart app.

The Walmart class action says the retail giant makes a widespread practice of misrepresenting prices on its app. The plaintiff states that this practice violates California law including the Unfair Competition Law, the Consumer Legal Remedies Act, and the False Advertising Law.

Maynez seeks damages on behalf of herself and all other similarly affected consumers around the country who, in the last four years, used Walmart’s e-commerce app, found a quoted price, and then purchased the same item at a store for a price higher than that advertised on the app at the time of their purchase.

Additionally, she hopes to represent an Injunctive Relief Class of those consumers who saw a price on the app, but were offered the item at a higher price in-store, even if they did not purchase the item.

She seeks for Walmart to be required to disgorge all profits gained from wrongfully representing prices to entice consumers into making purchases. She also wants damages on behalf of herself and all consumers allegedly injured by Walmart’s conduct.

The Walmart pricing class action lawsuit asserts that Walmart knew that its online prices were lower than the in-store prices, and made them inconsistent in an act of “fraud, malice, and conscious disregard” for the rights of its consumers. 

Allegedly, Walmart intentionally misled its consumers in the interest of its own profits, knowing consumers would be enticed by the low prices represented on the app.

According to the Walmart app pricing class action lawsuit, the company was unjustly enriched by its misrepresentation of online and in-store prices, at the expense of its unknowing consumers.

    I purchased a pool online for $200 it was advertised as the complete pool with pump,filter,liner ,and 3 boxes .when finally received it was 1 box with a couple of rails and debris cover .I called and they said there was nothing they could do that I needed to purchase the other boxes they where suppose to have the box picked up and no one came I had also put insurance on pool that was all I recieved back which was $48 not the $200. at At Christmas I was ordering a Fisher price item advertised online for!$14.98 and put in cart and it was $24.99 did online chat and girl said I had to purchase online and I said how do you think I am writing to you and she said there nothing she could do so I did ‘nt purchase Walmart is the worst

    Saw a TV on clearance with the Walmart app, went into multiple stores when I finally found a store carrying it I went there an hour away for them to laugh in my face and state they don’t match the app because people can put their own prices on it.

    I literally had this happen to me, so I went to customer service to return the items. I asked the Customer service rep why do they charge more than the app? One lady was rude and just said the price in the store is different than the app, and another walmart employee told my husband that they are suppose to compare prices with their online app, but when we ask they tell us they won’t everytime. Walmart is just screwing people out of their hard earned money.

    Just a couple of weeks ago, Went to buy my mother in law a TV mount online 11.00 in store 20.00 walmart! Happens all the time.

    I’ve noticed this many times and it irritates me, especially since Walmart has changed its policy on advertised prices.

    I purchased a Nostalgia HDT 600 Teal Hotdog cooker at the store with some other items and noticed that what I spent was more than what it should be. When I got home I was reviewing my receipt noticed they charged me $25 for the hotdog cooker. I took it back to ask why I was charged that when clearly online it says $15. I was informed the store price is $29 but I was given a discount because the box was bent. I picked up the item from the clearance section.

    Keurig kcup classic rings $21 in ap, but in store it rings up for $79. And they say it must be a glitch

    Several of their items are priced cheaper online. This has happened multiple times to me.

    Walmart misrepresents their prices all the time on the app but when you get to store the item is a different price. Or when it shows one price on the app amd you add item to cart it shows up at a different price. I take screen shots and try to price match but it rarely happens
